1An Act to create
84.06 (1s) of the statutes; relating to: scope of highway
Analysis by the Legislative Reference Bureau
This bill requires, with several exceptions, that a Department of
Transportation plan for a highway improvement involving reconstruction or
replacement of an existing highway must be for an improvement that is of
substantially the same scope as the highway being reconstructed or replaced,
including the use of the same or similar materials and substantial maintenance of
the existing footprint.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
84.06 (1s) of the statutes is created to read:
84.06 (1s) Replace in kind.
(a) Except as provided in par. (b), for any highway 5
improvement within the department's jurisdiction that involves the reconstruction 6
or replacement of an existing highway, the project plan prepared by the department
shall be for an improvement that is of substantially the same scope as the highway 2
being reconstructed or replaced, including the use of the same or similar materials 3
and substantial maintenance of the existing footprint.
(b) The project plan prepared by the department may exceed the scope provided 5
under par. (a) to the extent that the department determines is necessary for safety 6
purposes, to meet current federal or state standards, or to accommodate estimated 7
