SENATE AMENDMENT 5, TO SENATE BILL 239

SB239-SA5,1,1 At the locations indicated, amend the bill as follows:

SB239-SA5,1,2 1. Page 5, line 9: delete “A setback".

SB239-SA5,1,3 2. Page 5, line 10: delete lines 10 to 12.

SB239-SA5,1,8 3. Page 13, line 9: delete lines 9 to 13 and substitute “construct, modify, maintain, and operate conduit, cable, and related appurtenances under a right-of-way. Such small wireless facilities, conduit, cable, and appurtenances, and activities related to their installation and maintenance, may not obstruct or hinder travel, drainage, maintenance,”.

SB239-SA5,1,10 4. Page 13, line 20: delete the material beginning with that line and ending with page 14, line 15, and substitute:

SB239-SA5,2,4 “2. With regard to the rights of a wireless provider to construct small wireless facilities or modify conduit, cable, and related appurtenances as described in subd. 1., a political subdivision may require a location other than the location proposed by the wireless provider, which the wireless provider shall use if, as determined by the political subdivision, the wireless provider has the right to use the alternate location on reasonable terms and conditions and the alternate location does not impose technical limits.”.
