AB1194,1,3 1An Act to create 947.09 of the statutes; relating to: providing material support
2to an organization that is engaged in domestic terrorism and providing a
3penalty.

Under this bill, it is a Class G felony to provide material support or resources
to an organization that is engaged in domestic terrorism. Under the bill, domestic
terrorism means engaging in activities that are dangerous to human life and that are
a violation of the criminal laws of the United States or of any state; that appear to
be intended to intimidate or coerce a civilian population, influence the policy of a
government by intimidation or coercion, or affect the conduct of a government by
mass destruction, assassination, or kidnapping; that serve an ideological goal; and
that occur primarily within the United States. Under the bill, material support or
resources means any tangible or intangible property or service except medicine or
religious materials.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 947.09 of the statutes is created to read:
AB1194,2,3 2947.09 Providing material support or resources to an organization
3engaged in domestic terrorism.
(1) Definitions. In this section:
AB1194,2,44 (a) “Domestic terrorism” means activities to which all of the following apply:
AB1194,2,65 1. The activities involve acts dangerous to human life that are a violation of the
6criminal laws of the United States or of any state.
AB1194,2,77 2. The activities appear to be intended to do one of the following:
AB1194,2,88 a. Intimidate or coerce a civilian population.
AB1194,2,99 b. Influence the policy of a government by intimidation or coercion.
AB1194,2,1110 c. Affect the conduct of a government by mass destruction, assassination, or
11kidnapping.
AB1194,2,1212 3. The activities serve an ideological goal.
AB1194,2,1413 4. The activities occur primarily within the territorial jurisdiction of the United
14States.
AB1194,2,1615 (b) “Expert advice or assistance” means advice or assistance derived from
16scientific, technical, or other specialized knowledge.
AB1194,2,2217 (c) “Material support or resources” means any tangible or intangible property
18or service, including currency or monetary instruments or financial securities,
19financial services, lodging, training, expert advice or assistance, safehouses, false
20documentation or identification, communications equipment, facilities, weapons,
21lethal substances, explosives, personnel, and transportation, except medicine or
22religious materials.
AB1194,2,2423 (d) “Training” means instruction or teaching designed to impart a specific skill,
24as opposed to general knowledge.

1(2) Criminal penalty. Whoever knowingly provides material support or
2resources to an organization that is engaged in domestic terrorism, or attempts or
3conspires to do so, is guilty of a Class G felony.
