AB159,19 6Section 19. 340.01 (5e) of the statutes is amended to read:
AB159,8,117 340.01 (5e) “Bicycle lane" means that portion of a roadway set aside by the
8governing body of any city, town, village, or county for the exclusive use of bicycles,
9electric scooters, electric personal assistive mobility devices, or other modes of travel
10where permitted under s. 349.23 (2) (a), and so designated by appropriate signs and
11pavement markings.
AB159,20 12Section 20. 340.01 (5s) of the statutes is amended to read:
AB159,8,1513 340.01 (5s) “Bicycle way" means any path or sidewalk or portion thereof
14designated for the use of bicycles, electric scooters, and electric personal assistive
15mobility devices by the governing body of any city, town, village, or county.
AB159,21 16Section 21 . 340.01 (15ps) of the statutes is created to read:
AB159,8,2217 340.01 (15ps) “Electric scooter” means a device weighing less than 100 pounds
18that has handlebars and an electric motor, is powered solely by the electric motor and
19human power, and has a maximum speed of not more than 20 miles per hour on a
20paved level surface when powered solely by the electric motor. “Electric scooter” does
21not include an electric personal assistive mobility device, motorcycle, motor bicycle,
22or moped.
AB159,22 23Section 22. 340.01 (35) of the statutes is amended to read:
AB159,9,624 340.01 (35) “Motor vehicle" means a vehicle, including a combination of 2 or
25more vehicles or an articulated vehicle, which is self-propelled, except a vehicle

1operated exclusively on a rail. “Motor vehicle" includes, without limitation, a
2commercial motor vehicle or a vehicle which is propelled by electric power obtained
3from overhead trolley wires but not operated on rails. A snowmobile, an all-terrain
4vehicle, a utility terrain vehicle, an electric scooter, and an electric personal assistive
5mobility device shall be considered motor vehicles only for purposes made
6specifically applicable by statute.
AB159,23 7Section 23. 340.01 (43) of the statutes is amended to read:
AB159,9,128 340.01 (43) “Pedestrian" means any person afoot or any person in a wheelchair,
9either manually or mechanically propelled, or other low-powered, mechanically
10propelled vehicle designed specifically for use by a physically disabled person, but
11does not include any person using an electric scooter or an electric personal assistive
12mobility device.

18A snowmobile, an all-terrain vehicle, a personal delivery device, an electric scooter,
19and an electric personal assistive mobility device shall not be considered a vehicle
20except for purposes made specifically applicable by statute.

6or property is or may be transported or drawn upon a highway, except vehicles used
7exclusively upon stationary rails or tracks and except electric scooters, electric
8personal assistive mobility devices, and personal delivery devices.
AB159,29 9Section 29. 346.02 (12) of the statutes is amended to read:

An electric scooter and an electric personal assistive
12mobility device shall be considered a vehicle for purposes of ss. 346.04 to 346.10,
13346.12, 346.13, 346.15, 346.16, 346.18, 346.19, 346.20, 346.215 (3), 346.23 to 346.28,
14346.31 to 346.35, 346.37 to 346.40, 346.44, 346.46, 346.47, 346.48, 346.50 to 346.55,
15346.57, 346.59, 346.62, 346.65 (5m), 346.67 to 346.70, 346.78, 346.80, 346.87, 346.88,
16346.90, 346.91, and 346.94 (4), (5), (9), and (10), except those provisions which by
17their express terms apply only to motor vehicles or which by their very nature would
18have no application to electric scooters or electric personal assistive mobility devices.
AB159,30 19Section 30. 346.05 (1m) of the statutes is amended to read:
AB159,10,2320 346.05 (1m) Notwithstanding sub. (1), any person operating a bicycle, electric
21scooter,
or electric personal assistive mobility device may ride on the shoulder of a
22highway unless such riding is prohibited by the authority in charge of the
23maintenance of the highway.

AB159,11,94 346.075 (1) The operator of a motor vehicle overtaking a bicycle, electric
5scooter,
or electric personal assistive mobility device proceeding in the same
6direction shall exercise due care, leaving a safe distance, but in no case less than 3
7feet clearance when passing the bicycle, electric scooter, or electric personal assistive
8mobility device, and shall maintain clearance until safely past the overtaken bicycle,
9electric scooter,
or electric personal assistive mobility device.
AB159,33 10Section 33. 346.16 (2) (am) of the statutes is amended to read:
AB159,11,1411 346.16 (2) (am) Notwithstanding s. 349.105 and except as provided in par. (b),
12no person riding an electric scooter or an electric personal assistive mobility device
13may go upon any expressway or freeway when official signs have been erected
14prohibiting persons specified in par. (a) from using the expressway or freeway.
AB159,34 15Section 34. 346.23 (1) of the statutes is amended to read:
AB159,12,716 346.23 (1) At an intersection or crosswalk where traffic is controlled by traffic
17control signals or by a traffic officer, the operator of a vehicle shall yield the
18right-of-way to a pedestrian or personal delivery device, or to a person who is riding
19a bicycle, electric scooter, or electric personal assistive mobility device in a manner
20which is consistent with the safe use of the crosswalk by pedestrians, that has started
21to cross the highway on a green signal or a pedestrian signal authorizing crossing
22and in all other cases pedestrians, bicyclists, and riders of electric scooters and
23electric personal assistive mobility devices shall yield, and personal delivery device
24operators shall ensure that personal delivery devices yield, the right-of-way to
25vehicles lawfully proceeding directly ahead on a green signal. No operator of a

1vehicle proceeding ahead on a green signal may begin a turn at a controlled
2intersection or crosswalk when a pedestrian, personal delivery device, bicyclist, or
3rider of an electric scooter or an electric personal assistive mobility device crossing
4in the crosswalk on a green signal or a pedestrian signal authorizing crossing would
5be endangered or interfered with in any way. The rules stated in this subsection are
6modified at intersections or crosswalks on divided highways or highways provided
7with safety zones in the manner and to the extent stated in sub. (2).
AB159,35 8Section 35. 346.23 (2) of the statutes is amended to read:
AB159,12,179 346.23 (2) At intersections or crosswalks on divided highways or highways
10provided with safety zones where traffic is controlled by traffic control signals or by
11a traffic officer, the operator of a vehicle shall yield the right-of-way to a pedestrian,
12personal delivery device, bicyclist, or rider of an electric scooter or an electric
13personal assistive mobility device that has started to cross the roadway either from
14the near curb or shoulder or from the center dividing strip or a safety zone with the
15green signal or a pedestrian signal authorizing crossing in the favor of the
16pedestrian, personal delivery device, bicyclist, or rider of an electric scooter or an
17electric personal assistive mobility device.
AB159,36 18Section 36. 346.24 (1) of the statutes is amended to read:
AB159,12,2419 346.24 (1) At an intersection or crosswalk where traffic is not controlled by
20traffic control signals or by a traffic officer, the operator of a vehicle shall yield the
21right-of-way to a pedestrian or personal delivery device, or to a person riding a
22bicycle, electric scooter, or electric personal assistive mobility device in a manner
23which is consistent with the safe use of the crosswalk by pedestrians, that is crossing
24the highway within a marked or unmarked crosswalk.
AB159,37 25Section 37. 346.24 (2) of the statutes is amended to read:

1346.24 (2) No pedestrian, personal delivery device, bicyclist, or rider of an
2electric scooter or
an electric personal assistive mobility device may suddenly leave,
3and no personal delivery device operator may allow a personal delivery device to
4suddenly leave, a curb or other place of safety and walk, run, or ride into the path
5of a vehicle which is so close that it is difficult for the operator of the vehicle to yield.
AB159,38 6Section 38. 346.24 (3) of the statutes is amended to read:
AB159,13,117 346.24 (3) Whenever any vehicle is stopped at an intersection or crosswalk to
8permit a pedestrian, personal delivery device, bicyclist, or rider of an electric scooter
9or
an electric personal assistive mobility device to cross the roadway, the operator of
10any other vehicle approaching from the rear may not overtake and pass the stopped
11vehicle.
AB159,39 12Section 39. 346.25 of the statutes is amended to read:
AB159,13,16 13346.25 Crossing at place other than crosswalk. Every pedestrian,
14bicyclist, or rider of an electric scooter or an electric personal assistive mobility device
15crossing a roadway at any point other than within a marked or unmarked crosswalk
16shall yield the right-of-way to all vehicles upon the roadway.
AB159,40 17Section 40. 346.28 (2) of the statutes is amended to read:
AB159,13,2018 346.28 (2) Operators of vehicles shall yield the right-of-way to pedestrians,
19personal delivery devices, bicyclists, and riders of electric scooter and electric
20personal assistive mobility devices on sidewalks as required by s. 346.47.
AB159,41 21Section 41. 346.30 (1) (b) 2. of the statutes is amended to read:
AB159,13,2422 346.30 (1) (b) 2. Any operator of a bicycle, electric scooter, or electric personal
23assistive mobility device violating s. 346.23, 346.24 or 346.25 may be required to
24forfeit not more than $20.
AB159,42 25Section 42. 346.34 (1) (b) of the statutes is amended to read:

1346.34 (1) (b) In the event any other traffic may be affected by the movement,
2no person may turn any vehicle without giving an appropriate signal in the manner
3provided in s. 346.35. A person making a U-turn shall use the same signal used to
4indicate a left turn. When given by the operator of a vehicle other than a bicycle,
5electric scooter,
or electric personal assistive mobility device, the signal shall be given
6continuously during not less than the last 100 feet traveled by the vehicle before
7turning. The operator of a bicycle, electric scooter, or electric personal assistive
8mobility device shall give the signal continuously during not less than the last 50 feet
9traveled before turning. A signal by the hand and arm need not be given
10continuously if the hand is needed in the control or operation of the bicycle, electric
11scooter,
or electric personal assistive mobility device.
AB159,43 12Section 43. 346.36 (2) of the statutes is amended to read:
AB159,14,1513 346.36 (2) Any operator of a bicycle, electric scooter, or electric personal
14assistive mobility device violating ss. 346.31 to 346.35 may be required to forfeit not
15more than $20.
AB159,44 16Section 44. 346.37 (1) (a) 2. of the statutes is amended to read:
AB159,14,2117 346.37 (1) (a) 2. Pedestrians, and persons who are riding bicycles, electric
18scooters,
or electric personal assistive mobility devices in a manner which is
19consistent with the safe use of the crosswalk by pedestrians, facing the signal may
20proceed, and personal delivery device operators may allow personal delivery devices
21to proceed, across the roadway within any marked or unmarked crosswalk.
AB159,45 22Section 45. 346.37 (1) (c) 2. of the statutes is amended to read:
AB159,15,223 346.37 (1) (c) 2. No pedestrian, personal delivery device, bicyclist, or rider of
24an electric scooter or an electric personal assistive mobility device facing such signal
25shall enter, and no personal delivery device operator may allow a personal delivery

1device facing such signal to enter, the roadway unless he or she can do so safely and
2without interfering with any vehicular traffic.
AB159,46 3Section 46. 346.37 (1) (c) 3. of the statutes is amended to read:
AB159,15,184 346.37 (1) (c) 3. Vehicular traffic facing a red signal at an intersection may, after
5stopping as required under subd. 1., cautiously enter the intersection to make a right
6turn into the nearest lawfully available lane for traffic moving to the right or to turn
7left from a one-way highway into the nearest lawfully available lane of a one-way
8highway on which vehicular traffic travels to the left. Vehicular traffic in the leftmost
9right-turn lane of a roadway that provides 2 right-turn lanes may make a right turn
10on a red signal into a lawfully available lane that is 2nd to the rightmost lane for
11traffic moving to the right. Except for a vehicle turning right from the leftmost
12right-turn lane of a roadway that provides 2 right-turn lanes, no turn may be made
13on a red signal if lanes of moving traffic are crossed. No turn may be made on a red
14signal if a sign at the intersection prohibits the turn on a red signal. In making a turn
15on a red signal vehicular traffic shall yield the right-of-way to pedestrians, personal
16delivery devices, bicyclists, and riders of electric scooters and electric personal
17assistive mobility devices lawfully within a crosswalk, to operators of vehicles
18making a lawful U-turn, and to other traffic lawfully using the intersection.
AB159,47 19Section 47. 346.37 (1) (c) 4. of the statutes is amended to read:
AB159,16,620 346.37 (1) (c) 4. Notwithstanding subd. 1., a motorcycle, moped, motor bicycle,
21or bicycle facing a red signal at an intersection may, after stopping as required under
22subd. 1. for not less than 45 seconds, proceed cautiously through the intersection
23before the signal turns green if no other vehicles are present at the intersection to
24actuate the signal and the operator of the motorcycle, moped, motor bicycle, or bicycle
25reasonably believes the signal is vehicle actuated. The operator of a motorcycle,

1moped, motor bicycle, or bicycle proceeding through a red signal under this
2subdivision shall yield the right-of-way to any vehicular traffic, pedestrian,
3personal delivery device, bicyclist, or rider of an electric scooter or an electric
4personal assistive mobility device proceeding through a green signal at the
5intersection or lawfully within a crosswalk or using the intersection. This
6subdivision does not affect any authorization for a bicyclist under subd. 2.
AB159,48 7Section 48. 346.37 (1) (d) 1. of the statutes is amended to read:
AB159,16,158 346.37 (1) (d) 1. Vehicular traffic facing a green arrow signal may enter the
9intersection to make the movement indicated by the arrow but shall yield the
10right-of-way to pedestrians, personal delivery devices, bicyclists, and riders of
11electric scooters and electric personal assistive mobility devices lawfully within a
12crosswalk and to other traffic lawfully using the intersection. Vehicular traffic facing
13a left turn arrow may make a U-turn unless a sign prohibits U-turns. When the
14green arrow signal indicates a right or left turn traffic shall cautiously enter the
15intersection.
AB159,49 16Section 49. 346.37 (1) (d) 2. of the statutes is amended to read:
AB159,16,2117 346.37 (1) (d) 2. No pedestrian, bicyclist, or rider of an electric scooter or an
18electric personal assistive mobility device facing such signal may enter, and no
19personal delivery device operator may allow a personal delivery device facing such
20signal to enter, the roadway unless he or she can do so safely and without interfering
21with any vehicular traffic.
AB159,50 22Section 50. 346.37 (1) (e) 1. of the statutes is amended to read:
AB159,17,323 346.37 (1) (e) 1. Vehicular traffic facing a flashing yellow arrow signal may
24cautiously enter the intersection to make the movement indicated by the arrow but
25shall yield the right-of-way to pedestrians, personal delivery devices, bicyclists, and

1riders of electric scooters and electric personal assistive mobility devices lawfully
2within a crosswalk and to other traffic lawfully using the intersection. Vehicular
3traffic facing a left turn arrow may make a U-turn unless a sign prohibits U-turns.
AB159,51 4Section 51. 346.37 (1) (e) 2. of the statutes is amended to read:
AB159,17,95 346.37 (1) (e) 2. No pedestrian, bicyclist, or rider of an electric scooter or an
6electric personal assistive mobility device facing such signal may enter, and no
7personal delivery device operator may allow a personal delivery device facing such
8signal to enter, the roadway unless he or she can do so safely and without interfering
9with any vehicular traffic.
AB159,52 10Section 52. 346.37 (3) of the statutes is amended to read:
AB159,17,1811 346.37 (3) If a traffic control signal suffers a loss of power or otherwise
12malfunctions so that the traffic control signal does not exhibit any color of light,
13vehicular traffic, pedestrians, and persons riding bicycles, electric scooters, or
14electric personal assistive mobility devices shall proceed, and personal delivery
15device operators shall ensure that personal delivery devices proceed, at the traffic
16control signal as if the traffic control signal were an official stop sign and shall comply
17with the requirements applicable under ss. 346.18 (1) and (3) and 346.46 (1), (2), and
18(4), unless otherwise directed by a traffic officer.
AB159,53 19Section 53. 346.38 (1) of the statutes is amended to read:
AB159,18,220 346.38 (1) Walk. A pedestrian, or a person riding a bicycle, electric scooter, or
21electric personal assistive mobility device in a manner which is consistent with the
22safe use of the crossing by pedestrians, facing a pedestrian signal authorizing
23crossing may proceed, and a personal delivery device operator may allow a personal
24delivery device facing a pedestrian signal authorizing crossing to proceed, across the
25roadway or other vehicular crossing in the direction of the signal and the operators

1of all vehicles shall yield the right-of-way to the pedestrian, personal delivery
2device, bicyclist, or electric scooter or electric personal assistive mobility device rider.
AB159,54 3Section 54. 346.38 (2) of the statutes is amended to read:
AB159,18,124 346.38 (2) Don't walk. No pedestrian, personal delivery device, bicyclist, or
5rider of an electric scooter or an electric personal assistive mobility device may start
6to cross, and no personal delivery device operator may allow a personal delivery
7device to start to cross, the roadway or other vehicular crossing in the direction of a
8pedestrian signal limiting crossing, regardless of whether the signal is steady or
9flashing, but any pedestrian, personal delivery device, bicyclist, or rider of an electric
10scooter or
an electric personal assistive mobility device that has partially completed
11crossing on the pedestrian signal authorizing crossing may proceed to a sidewalk or
12safety zone while a pedestrian signal limiting crossing is showing.
AB159,55 13Section 55. 346.43 (1) (b) 2. of the statutes is amended to read:
AB159,18,1614 346.43 (1) (b) 2. Any operator of a bicycle, electric scooter, or electric personal
15assistive mobility device violating s. 346.37, 346.38 or 346.39 may be required to
16forfeit not more than $20.
AB159,56 17Section 56. 346.47 (1) of the statutes is amended to read:
AB159,18,2418 346.47 (1) The operator of a vehicle emerging from an alley or about to cross
19or enter a highway from any point of access other than another highway shall stop
20such vehicle immediately prior to moving on to the sidewalk or on to the sidewalk
21area extending across the path of such vehicle and shall yield the right-of-way to any
22pedestrian, bicyclist, personal delivery device, or rider of an electric scooter or an
23electric personal assistive mobility device, and upon crossing or entering the
24roadway shall yield the right-of-way to all vehicles approaching on such roadway.
AB159,57 25Section 57. 346.49 (1) (b) of the statutes is amended to read:

1346.49 (1) (b) Any operator of a bicycle , electric scooter, or electric personal
2assistive mobility device violating s. 346.46 (1), (2m) or (4) may be required to forfeit
3not more than $20.
AB159,58 4Section 58. 346.49 (1g) (b) of the statutes is amended to read:
AB159,19,65 346.49 (1g) (b) Any operator of a bicycle, electric scooter, or electric personal
6assistive mobility device violating s. 346.46 (3) shall forfeit not more than $40.
AB159,59 7Section 59. 346.49 (2m) (b) of the statutes is amended to read:
AB159,19,118 346.49 (2m) (b) Any operator of a bicycle, electric scooter, or electric personal
9assistive mobility device violating s. 346.44 may be required to forfeit not less than
10$100 nor more than $250 for the first offense and not less than $225 nor more than
11$750 for the 2nd or subsequent conviction within 3 years.
AB159,60 12Section 60. 346.54 (1) (e) of the statutes is amended to read:
AB159,19,2013 346.54 (1) (e) Except as provided in par. (cm) and s. 349.13 (6), for the purpose
14of parking, mopeds, electric scooters, and electric personal assistive mobility devices
15shall be considered bicycles. Except as provided in s. 349.13 (6), where possible
16without impeding the flow of pedestrian traffic, a bicycle, moped, electric scooter, or
17electric personal assistive mobility device may be parked on a sidewalk. Except as
18provided in s. 349.13 (6), a bicycle, moped, electric scooter, or electric personal
19assistive mobility device may be parked in a bike rack or other similar area
20designated for bicycle parking.
AB159,61 21Section 61. 346.60 (5) (a) of the statutes is amended to read:
