Notice of Public Hearing and Comment Period on Statement of Scope
The Wisconsin Department of Transportation announces that it will hold a public hearing on statement of scope SS 054-22, indicating WisDOT’s intent to engage in rulemaking to revise ch. Trans 138, Wis. Admin. Code, relating to motor vehicle auction dealers. The statement of scope for this proposed rule was published in Wis. Admin. Registister No. 799A1 on July 5, 2022. In accordance with s. 227.136, Stats., WisDOT will hold a public hearing and receive public comments regarding the proposed rulemaking as described in SS 054-22, as follows, at the time and place shown below.

Rule Information
This is a statement of scope for a proposed permanent rule. No rule has yet been drafted. These changes are proposed to clarify the department’s interpretation of s. 218.34, Stats. The department previously interpreted the statute as saying the department may only issue a license after the statutory procedure for assessing and issuing license has concluded and only permits persons holding said license to bid on automobiles at an auction after the license process is completed. Rulemaking is necessary to clarify the department’s interpretation of s. 218.34, Stats., to include any conditions, limitations, or restrictions the department may deem appropriate to ensure accurate bidder identity, system integrity, fraud avoidance, and commercial efficiency.

Comments on the proposed scope statement must be received on or before 4:00 p.m. on Monday, August 1, 2022. Written comments may be submitted by U.S. mail or e-mail and will have the same weight and effect as oral statements presented at the public hearing.
