ATCP 125.01(1m) (1m) “Electronic communications service” has the meaning given in s. ATCP 123.01 (5).

ATCP 125.01(1s) (1s) “Manufactured home” means any of the following:

ATCP 125.01(1s)(a) (a) A manufactured home as defined in s. 101.91 (2) (am), Stats.

ATCP 125.01(1s)(b) (b) A unit designed to be towed or transported and used as a residential dwelling, but does not include a unit used primarily for camping, touring, or recreational purposes.

ATCP 125.01(2) (2) “Manufactured home community” means any tract of land containing 2 or more sites.

ATCP 125.01(3) (3) “Operator” means any person engaged in the business of renting sites in a manufactured home community to tenants. “Operator” includes officers, representatives, agents, and employees.

ATCP 125.01(4) (4) “Person” means any individual, corporation, partnership, association, business organization or entity.

ATCP 125.01(5) (5) “Rental agreement” means an agreement between an operator and a tenant for the rental of a site.

ATCP 125.01(6) (6) “Security deposit” means the total of all payments and deposits given by a tenant to the operator as security for the performance of the tenant’s obligations, and includes all rent payments in excess of one month’s prepaid rent.

ATCP 125.01(7) (7) “Site” means any plot of land that is rented or offered for rental for the accommodation of a manufactured home used for residential purposes. It does not include a plot of land rented for the accommodation of a manufactured home that is:

ATCP 125.01(7)(a) (a) Occupied on a strictly seasonal basis; or

ATCP 125.01(7)(b) (b) Owned by the operator and occupied as a residence.

ATCP 125.01(9) (9) “Tenant” means any person residing in a manufactured home and renting a site from an operator.

ATCP 125.01(10) (10) “Utility service” means:

ATCP 125.01(10)(a) (a) Electricity and natural gas;

ATCP 125.01(10)(b) (b) Liquified petroleum gas other than liquified petroleum gas in portable containers;

ATCP 125.01(10)(c) (c) Fuel oil supplied through a permanent central system in the manufactured home community; and

ATCP 125.01(10)(d) (d) Electronic communications service.

ATCP 125.02 ATCP 125.02 Tie-in sales; separate or discriminatory charges. No operator shall:

ATCP 125.02(1) (1) Require, as a condition to the rental of any site, the purchase of a manufactured home from the operator or any dealer, manufacturer, or agent named by the operator.

ATCP 125.02(2) (2) Represent to any person that the purchase of a manufactured home from the operator or any dealer, manufacturer, or agent named by the operator will give the purchaser an advantage over others in the rental or continued occupancy of a site.

ATCP 125.02(3) (3) Discriminate or threaten to discriminate in rental charges or in any other respect against a tenant for failure of the tenant to purchase a manufactured home from the operator or any dealer, manufacturer, or agent named by the operator.

ATCP 125.02(4) (4) Solicit or receive any payment or other thing of value from any seller of a manufactured home for agreeing to rent a site to the purchaser of such manufactured home.

ATCP 125.02(5) (5) Solicit or receive any payment or other thing of value from any person upon the representation or understanding that such consideration will give that person an advantage over others in the rental or continued occupancy of a site.

ATCP 125.02(6) (6) Use a manufactured home site to display a manufactured home offered for sale, or rent a site to a manufactured home dealer for purposes other than accommodation of a manufactured home occupied as a residence, if the use or rental of the site results in there being no site in the manufactured home community available to a prospective tenant who does not purchase a manufactured home from the operator or renting dealer.

ATCP 125.03 ATCP 125.03 Rental agreement; requirements.

ATCP 125.03(1) (1) Every rental agreement shall be in writing. A copy of the rental agreement shall be furnished to the tenant at the time the rental agreement is executed. If a manufactured home is purchased from or through the operator, a copy of the rental agreement shall be furnished to the tenant before the tenant signs the manufactured home purchase contract.
