SB193-SSA1,16 Section 16. 440.08 (3m) of the statutes is created to read:

SB193-SSA1,13,19 440.08 (3m) Continuing education. The department or the interested examining board or affiliated credentialing board, as appropriate, may, as provided in s. 440.20 (6), specify makeup continuing education requirements that must be completed in order for the holder of a credential who fails to complete continuing education requirements within a required period to be able to renew the credential, notwithstanding the failure.

SB193-SSA1,17 Section 17 . 440.08 (4) (a) of the statutes is amended to read:

SB193-SSA1,14,8 440.08 (4) (a) Generally. If the department or the interested examining board or affiliated credentialing board, as appropriate, determines that an applicant for renewal has failed to comply with sub. (2) (c) (2r) (a) or (3) or with any other applicable requirement for renewal established under chs. 440 to 480 or that the denial of an application for renewal of a credential is necessary to protect the public health, safety or welfare, the department, examining board or affiliated credentialing board may summarily deny the application for renewal by mailing to the holder of the credential a notice of denial that includes a statement of the facts or conduct that warrant the denial and a notice that the holder may, within 30 days after the date on which the notice of denial is mailed, file a written request with the department to have the denial reviewed at a hearing before the department, if the department issued the credential, or before the examining board or affiliated credentialing board that issued the credential.

SB193-SSA1,18 Section 18 . 440.09 (3) (a) of the statutes is amended to read:

SB193-SSA1,14,15 440.09 (3) (a) A reciprocal credential granted under this section expires on the applicable renewal date specified in determined under s. 440.08 (2) (a), except that if the first renewal date specified in s. 440.08 (2) (a) after the date on which the credential is granted is within 180 365 days of the date on which the credential is granted, the credential expires on the 2nd renewal date specified in s. 440.08 (2) (a) after the date on which the credential is granted.

SB193-SSA1,19 Section 19. 440.20 (6) of the statutes is created to read:

SB193-SSA1,14,22 440.20 (6) (a) The department or appropriate examining board, affiliated credentialing board, or board in the department may reprimand the holder of a credential or deny, limit, suspend, or revoke the credential of any person who fails to satisfy applicable continuing education requirements within a required period and may specify makeup continuing education requirements that must be completed in order to maintain his or her credential or to restore it to good standing.

SB193-SSA1,14,24 (b) The grounds for discipline specified under par. (a) are in addition to any grounds for discipline specified in chs. 440 to 480.

SB193-SSA1,20 Section 20 . 440.26 (3) of the statutes is amended to read:

SB193-SSA1,15,13 440.26 (3) Issuance of licenses; fees. Upon receipt and examination of an application executed under sub. (2), and after any investigation that it considers necessary, the department shall, if it determines that the applicant is qualified, grant the proper license upon payment of the initial credential fee determined by the department under s. 440.03 (9) (a). No license shall be issued for a longer period than 2 4 years, and the license of a private detective shall expire on the renewal date of the license of the private detective agency, even if the license of the private detective has not been in effect for a full 2 4 years. Renewals of the original licenses issued under this section shall be issued in accordance with renewal forms prescribed by the department and shall be accompanied by the applicable fees specified in s. 440.08 or determined by the department under s. 440.03 (9) (a). The department may not renew a license unless the applicant provides evidence that the applicant has in force at the time of renewal the bond or liability policy specified in this section.

SB193-SSA1,21 Section 21 . 440.26 (5m) (b) of the statutes is amended to read:

SB193-SSA1,15,18 440.26 (5m) (b) The renewal dates for permits issued under this subsection are specified shall be as determined under s. 440.08 (2) (a). Renewal applications shall be submitted to the department on a form provided by the department and shall include the renewal fee determined by the department under s. 440.03 (9) (a).

Renewal applications shall be submitted to the department on a form provided by the department on or before the applicable renewal date specified determined under s. 440.08 (2) (a) and shall include the applicable renewal fee determined by the department under s. 440.03 (9) (a).

SB193-SSA1,25 Section 25 . 440.88 (4) of the statutes is amended to read:

SB193-SSA1,16,20 440.88 (4) Applications; certification period. An application for certification as a substance abuse counselor, clinical supervisor, or prevention specialist under this section shall be made on a form provided by the department and filed with the department and shall be accompanied by the initial credential fee determined by the department under s. 440.03 (9) (a). The renewal date for certification as a substance abuse counselor, clinical supervisor, or prevention specialist is specified shall be as determined under s. 440.08 (2) (a) and the renewal fee for such certifications is determined by the department under s. 440.03 (9) (a). Renewal of certification as a substance abuse counselor-in-training, a clinical supervisor-in-training, or a prevention specialist-in-training may be made only twice.

SB193-SSA1,26 Section 26 . 440.905 (2) of the statutes is amended to read:

SB193-SSA1,17,2 440.905 (2) The board has rule-making authority and may promulgate rules relating to the regulation of cemetery authorities, cemetery salespersons, and cemetery preneed sellers. The board may determine, by rule, a fee under s. 440.05 (1) (a) and under s. 440.08 (2) (a) 21. that is sufficient to fund the board's operating costs.
