SB834,,33Analysis by the Legislative Reference Bureau This bill dissolves the Elections Commission and requires the secretary of state to assume the duties of the commission, effective January 4, 2027. Under the bill, the administrator of the commission must work with the secretary of state to ensure a smooth transition from the commission to the office of the secretary of state and to formulate an implementation plan. Under the bill, all assets, liabilities, and tangible personal property of the commission are transferred to secretary of state. In addition, all incumbent employees holding positions at the commission on the bill’s effective date, other than the administrator, are transferred to the office of the secretary of state.
Under the bill, the standing committees in each house of the legislature with jurisdiction over election administration are advisory to the secretary of state on all matters relating to the operation of the office of the secretary of state with regard to the election administration. Except for action related to the internal operations and procedures of the office, the office of the secretary of state may take no action with regard to election administration without getting prior approval from the standing committees in each house of the legislature with jurisdiction over election administration.
