ATCP 93.240(16)(a)(a) General. Except as provided in par. (g), no person may install an aboveground tank system that is regulated under this chapter unless the person complies with one of the following:
ATCP 93.240(16)(a)1.1. The person holds a certification issued by the department as a certified aboveground tank system installer.
ATCP 93.240(16)(a)2.2. The person holds a Wisconsin registration as a professional engineer and is competent in the engineering methods and requirements in Wisconsin for designing and installing storage tank systems for flammable, combustible or hazardous liquids.
ATCP 93.240(16)(a)3.3. The person is under the direct supervision of another person who holds a certification or registration under subd. 1. or 2. and who is responsible for the installation.
ATCP 93.240(16)(b)(b) Application for examination. A person applying to take an aboveground tank system installer certification examination shall submit all of the following:
ATCP 93.240(16)(b)1.1. An application in accordance with sub. (2)
ATCP 93.240(16)(b)2.2. An application fee and examination fee in accordance with Table 93.240.
ATCP 93.240(16)(c)(c) Examination. A person seeking to obtain an aboveground tank system installer certification shall take and pass an examination in accordance with sub. (9).
ATCP 93.240(16)(d)(d) Application for certification. Upon notification of successfully passing the examination for an aboveground tank system installer certification, a person may obtain the certification by submitting an application and the certification fee in accordance with sub. (2).
ATCP 93.240(16)(e)(e) Responsibilities. A person who installs or supervises the installation of tank systems as a certified aboveground tank system installer shall be present at the job site for at least all of the following activities:
ATCP 93.240(16)(e)1.1. Preinstallation tank system testing.
ATCP 93.240(16)(e)2.2. Inspection and repair of coatings.
ATCP 93.240(16)(e)3.3. Placement of tanks.
ATCP 93.240(16)(e)4.4. Installation and testing of all connections and tank-related piping including vapor recovery, vents and supply pipes.
ATCP 93.240(16)(e)5.5. Installation of monitoring or leak detection devices.
ATCP 93.240(16)(e)6.6. Installation of pumps.
ATCP 93.240(16)(e)7.7. Installation of any underground piping.
ATCP 93.240(16)(f)(f) Renewal.
ATCP 93.240(16)(f)1.1.
ATCP 93.240(16)(f)1.a.a. A person may renew a certification as an aboveground tank system installer.
ATCP 93.240(16)(f)1.b.b. An aboveground tank system installer certification shall be renewed in accordance with sub. (7).
ATCP 93.240(16)(f)2.2.
ATCP 93.240(16)(f)2.a.a. The renewal of a certification as an aboveground tank system installer shall be contingent upon the installer obtaining at least 12 hours of acceptable continuing education prior to the expiration date of the certification as specified in sub. (8) and Table 93.240, except as provided in subd. 2. b.
ATCP 93.240(16)(f)2.b.b. A person who holds a certification as an aboveground tank system installer may apply to the department for waiver of the continuing education requirements under subd. 2. a. on the grounds of prolonged illness or disability or similar circumstances. Each application for waiver shall be considered individually on its merits by the department.
ATCP 93.240(16)(g)(g) Exclusion. This subsection does not apply to field-constructed aboveground tanks.
ATCP 93.240(17)(17)Underground tank system installers.
ATCP 93.240(17)(a)(a) General. No person may install an underground tank system that is regulated under this chapter unless the person complies with one of the following:
ATCP 93.240(17)(a)1.1. The person holds a certification issued by the department as a certified underground tank system installer.
ATCP 93.240(17)(a)2.2. The person holds a registration as a Wisconsin professional engineer and is competent in the engineering methods and requirements in Wisconsin for designing and installing storage tank systems for flammable, combustible, or hazardous liquids.
