20services, and department of workforce development employees and their
21family members. The person threatens the person or family member of any
22department of revenue, department of safety and professional services, or
23department of workforce development official, employee, or agent under all of the
24following circumstances:

1(a) At the time of the threat, the person knows or should have known that the
2victim is a department official, employee, or agent or a member of his or her family.
SB121,23,43(b) The official, employee, or agent is acting in an official capacity at the time
4of the threat, or the threat is in response to any action taken in an official capacity.
