1To amend so as in effect to repeal section 13 of article XIII of the constitution;
2relating to: eliminating constitutional restrictions on marriage (first
3consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 2025 legislature on first consideration, eliminates the constitutional restriction that only a marriage between one man and one woman shall be valid or recognized as a marriage in this state and the provision that a legal status identical or substantially similar to that of a marriage for unmarried individuals shall not be valid or recognized in this state.
A proposed constitutional amendment requires adoption by two successive legislatures, and ratification by the people, before it can become effective.
SJR68,1,44Resolved by the senate, the assembly concurring, That:
SJR68,15Section 1. Section 13 of article XIII of the constitution is amended so as in
6effect to repeal said section:
SJR68,2,37[Article XIII] Section 13. Only a marriage between one man and one woman

1shall be valid or recognized as a marriage in this state. A legal status identical or
2substantially similar to that of marriage for unmarried individuals shall not be
3valid or recognized in this state.
SJR68,2,64Be it further resolved, That this proposed amendment be referred to the
5legislature to be chosen at the next general election and that it be published for
6three months previous to the time of holding such election.
