1An Act to create 5.051 of the statutes; relating to: the suspension of a rule of
2the Elections Commission. Analysis by the Legislative Reference Bureau
This bill is introduced as required by s. 227.26 (2) (j), stats., in support of the action of the Joint Committee for Review of Administrative Rules in suspending emergency rule 2408 of the Wisconsin Elections Commission on July 22, 2024. The suspended emergency rule 1) described requirements and procedures for filing a declaration of candidacy for a local, state, or federal office (declaration of candidacy), 2) identified grounds for bringing challenges to a declaration of candidacy, and 3) described the procedures by which the commission or filing officer would hear and decide these complaints for such challenges and the ability of an individual to seek review of the commission’s or filing officer’s decision on the complaint.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
AB14,13Section 1. 5.051 of the statutes is created to read: AB14,2,345.051 Repeal of emergency rule. The emergency rule promulgated by the
1elections commission that took effect on July 1, 2024, and that created ss. EL 2.06 2and 2.08, Wis. Adm. Code, relating to challenge procedures for declarations of 3candidacy, is repealed.
