AB722,,22An Act to create 20.933 of the statutes; relating to: prohibited considerations in awarding state or local financial assistance. AB722,,33Analysis by the Legislative Reference Bureau Under this bill, no state agency or local governmental unit may do any of the following in awarding a grant or loan or other financial assistance to any person:
1. Discriminate against the person based on the person’s participation in production agriculture or the exploration, production, use, transport, sale, or manufacture of fossil fuel–based energy.
2. Consider social and governance criteria; diversity, equity, and inclusion policies; or political and ideological factors.
The bill does not apply to the State of Wisconsin Investment Board or any assets under its management.

(1) Definitions. In this section: AB722,,77(a) “Covered activity” means any of the following: AB722,,881. Production agriculture. AB722,,992. The exploration, production, use, transport, sale, or manufacture of fossil fuel–based energy. AB722,,1010(b) “Local governmental unit” has the meaning given in s. 66.0135 (1) (c). AB722,,1111(c) “Prohibited basis” means any of the following: AB722,,12121. Social and governance criteria. AB722,,13132. Diversity, equity, and inclusion policies. AB722,,14143. Political and ideological factors. AB722,,1515(2) Prohibition. (a) Except as expressly provided by statute, no state agency or local governmental unit may do any of the following in awarding a grant or loan or other financial assistance to any person: AB722,,16161. Discriminate against the person on the basis of the person’s participation in a covered activity. AB722,,17172. Consider a prohibited basis. AB722,,1818(b) Paragraph (a) does not apply to the investment board or any assets under its management.
