Under current law, the Department of Natural Resources issues WPDES (water pollutant discharge elimination system) permits and stormwater discharge permits. This bill requires a person who, as part of the person’s activities under such a permit, creates a retention pond to install and maintain a fence around the perimeter of the retention pond and install signage that identifies the presence of the retention pond and warns of the dangers of entering the pond.
AB1117,,44The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:
AB1117,15Section 1. 283.56 of the statutes is created to read:
AB1117,,66283.56 Fencing and signage of retention ponds. (1) In this section, “retention pond” means a temporary or permanent artificial water body designed to reduce the water quantity or water quality impacts of water received from a person holding a permit under this chapter for any period of time. “Retention pond” includes an absorption, detention, storage, stormwater management, or treatment pond or lagoon.
AB1117,,77(2) Any person who is required to obtain a permit under this chapter and who, as part of the activities covered under the permit, creates or causes to be created a retention pond shall, as a condition of that permit, do all of the following:
AB1117,,88(a) Install and maintain fencing around the perimeter of the retention pond that is designed to keep individuals from entering the retention pond.
AB1117,,99(b) Install and maintain signage at the retention pond that clearly identifies the presence of the retention pond and notifies individuals of the dangers of entering the retention pond.
