SB951,1,3 1An Act to create 20.465 (3) (x), 25.17 (1) (gg), 25.34 and 323.65 of the statutes;
2relating to: creating a hazard mitigation revolving loan program and making
3an appropriation.
Analysis by the Legislative Reference Bureau
This bill authorizes the Division of Emergency Management in the Department
of Military Affairs to enter into an agreement with the Federal Emergency
Management Agency (FEMA) to receive federal funding for the purpose of
establishing a hazard mitigation revolving loan program. The bill creates a separate,
nonlapsible trust fund, designated as the Hazard Mitigation Revolving Loan Fund,
to accept money from FEMA under the federal Safeguarding Tomorrow through
Ongoing Risk Mitigation (STORM) Act, Public Law 116-284. Under the bill, if DMA
enters into such an agreement with FEMA, DMA must provide loans to local units
of government for hazard mitigation projects in accordance with the requirements
of the STORM Act.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB951,2 1Section 2. 20.465 (3) (x) of the statutes is created to read:

3revolving loan fund.
From the hazard mitigation revolving loan fund, as a continuing
4appropriation, the amounts in the schedule to provide loans under s. 323.65.
SB951,3 5Section 3. 25.17 (1) (gg) of the statutes is created to read:
SB951,2,66 25.17 (1) (gg) Hazard mitigation revolving loan fund (s. 25.34);
SB951,4 7Section 4. 25.34 of the statutes is created to read:
SB951,2,9 825.34 Hazard mitigation revolving loan fund. (1) Definition. In this
9section, “fund” means the hazard mitigation revolving loan fund.
SB951,2,11 10(2) Creation. There is established a separate nonlapsible trust fund
11designated as the hazard mitigation revolving loan fund, to consist of the following:
SB951,2,1312 (a) All moneys transferred from the general fund to the hazard mitigation
13revolving loan fund.
SB951,2,1514(b) All moneys received from the federal government under 42 USC 5135,
15designated for loans under the fund.
SB951,2,1716 (c) All repayments of principal and payments of interest on loans made under
17s. 323.65.
SB951,5 18Section 5. 323.65 of the statutes is created to read:

1323.65 Hazard mitigation revolving loan program. (1) Authorization.
2The division may enter into an agreement with the federal government as provided
3in 42 USC 5135, to provide hazard mitigation loans to local units of government
4under sub. (2).
SB951,3,10 5(2) Establishment. If an agreement is entered into as provided under sub. (1),
6the division shall establish and administer a hazard mitigation revolving loan
7program under which the division provides loans to local units of government from
8the appropriation under s. 20.465 (3) (x) for the purpose of funding hazard mitigation
9projects in accordance with the requirements of 42 USC 5135 and the agreement
10entered into under sub. (1).
