relating to:
3the penalty for operating a motor vehicle while operating privileges have been
4suspended and providing a penalty.
Analysis by the Legislative Reference Bureau
This bill modifies the penalty for a person who operates a motor vehicle while
the person's operating privilege has been suspended (OWS).
Under current law, no person may operate a motor vehicle upon a highway
unless the person possesses a valid operator's license that is not revoked, suspended,
canceled, or expired. The penalty for operating a motor vehicle without a license
(OWL) is a forfeiture of not more than $200 for the first offense, a fine of not more
than $300 and imprisonment for not more than 30 days for the second offense
occurring within 3 years, and a fine of not more than $500 and imprisonment for not
more than 6 months for the third or subsequent offense occurring within 3 years.
Under current law, the penalty for an OWS violation that does not cause great
bodily harm or death is a forfeiture of $50 to $200. The bill modifies the penalty for
OWS so that it is the same as OWL violations.
