AB986,1,4 1An Act to amend 16.75 (1) (a) 1.; and to create 16.756 and 20.932 of the statutes;
2relating to: prohibition on awarding state contracts or grants to entities that
3require customers or clients to provide proof of vaccination for COVID-19 for
4entry onto the premises of the entity or before providing services.
Analysis by the Legislative Reference Bureau
This bill prohibits the state and state agencies from awarding state contracts
or grants to businesses or other entities that require proof of vaccination against the
SARS-CoV-2 coronavirus, which causes COVID-19, as a condition of entering the
premises of the business or entity, or as a condition of receiving services.
For further information see the state fiscal estimate, which will be printed as
an appendix to this bill.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB986,1 5Section 1. 16.75 (1) (a) 1. of the statutes is amended to read:
AB986,2,76 16.75 (1) (a) 1. All orders awarded or contracts made by the department for all
7materials, supplies, equipment, and contractual services to be provided to any

1agency, except as otherwise provided in par. (c) and subs. (2), (2g), (2m), (3m), (3t),
2(6), (7), (8), (9), (10e), (10m), and (10p) and ss. 16.705 (1r), 16.73 (4) (a), 16.751, 16.754,
316.756, 50.05 (7) (f), 153.05 (2m) (a), 165.987, and 287.15 (7), shall be awarded to the
4lowest responsible bidder, taking into consideration life cycle cost estimates under
5sub. (1m), when appropriate, the location of the agency, the quantities of the articles
6to be supplied, their conformity with the specifications, and the purposes for which
7they are required and the date of delivery.
AB986,2 8Section 2. 16.756 of the statutes is created to read:
AB986,2,15 916.756 Proof of COVID-19 vaccination prohibited. No agency may enter
10into a contract for the procurement of materials, supplies, equipment, or contractual
11services under this subchapter with a vendor that requires any individual to furnish
12proof of having received a vaccine against the SARS-CoV-2 coronavirus, which
13causes COVID-19, before entering the vendor's premises. This section does not
14prohibit a vendor from implementing a screening protocol that does not require proof
15of having received a vaccine against the SARS-CoV-2 coronavirus.
AB986,3 16Section 3. 20.932 of the statutes is created to read:
AB986,2,22 1720.932 Grants prohibited. No state agency may award a grant to any entity
18that requires any individual to furnish proof of having received a vaccine against the
19SARS-CoV-2 coronavirus, which causes COVID-19, before entering the entity's
20premises or receiving services from the entity. This section does not prohibit an
21entity from implementing a screening protocol that does not require proof of having
22received a vaccine against the SARS-CoV-2 coronavirus.
