AB798,1,4 An Act to amend 119.04 (1); and to create 20.255 (2) (dv) and 115.457 of the statutes; relating to: an energy efficiency grant program for school districts, funding for the University of Wisconsin System, granting rule-making authority, and making an appropriation.

Analysis by the Legislative Reference Bureau

This bill creates a grant program under which the Department of Public Instruction must award grants to school districts for energy efficiency projects in school buildings. For the first two school years of the grant program, DPI must give preference in awarding grants to projects that relate to heating, ventilation, and air conditioning systems. DPI may promulgate rules to implement the grant program.

The bill also provides additional funding for the University of Wisconsin System under its general program operations for purposes of maintaining compliance with maintenance of effort requirements of the federal Consolidated Appropriations Act and the federal American Rescue Plan Act.

AB798,1 Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: - See PDF for table

AB798,2 Section 2. 20.255 (2) (dv) of the statutes is created to read:

AB798,2,5 20.255 (2) (dv) Energy efficiency projects; grants. The amounts in the schedule for grants to school districts under s. 115.457.

AB798,3 Section 3. 115.457 of the statutes is created to read:

AB798,2,9 115.457 Energy efficiency projects; grants. (1) Beginning in the 2022-23 school year, the department shall award grants to school districts for energy efficiency projects in school buildings.

AB798,2,12 (2) In awarding grants under this section for the 2022-23 and 2023-24 school years, the department shall give preference to projects that relate to heating, ventilation, and air conditioning systems.

AB798,2,13 (3) The department may promulgate rules to implement this section.

AB798,5 Section 5. Fiscal changes.

AB798,3,12 (1) UW System; general program operations. In the schedule under s. 20.005 (3) for the appropriation to the Board of Regents of the University of Wisconsin System under s. 20.285 (1) (a), the dollar amount for fiscal year 2022-23 is increased by $970,000 for the purpose for which the appropriation is made.
