AB640,1,3 1An Act to amend 28.05 (2), 28.11 (6) (b) 1. and 28.22 of the statutes; relating
2to:
the threshold amount of timber sold from state, county, or community
3forests above which certain approval and notice requirements apply.
Analysis by the Legislative Reference Bureau
This bill changes the threshold amount of timber sold from state, county, or
community forests at or above which certain approval and notice requirements
apply. Under current law, the approval and notice requirements apply to the sale of
timber with an estimated value of $3,000 or more. Under the bill, the requirements
apply to the sale of timber with either an estimated volume of at least 500 cord
equivalents or an estimated value of at least $10,000.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB640,1 4Section 1. 28.05 (2) of the statutes is amended to read:
AB640,2,65 28.05 (2) Procedure. Sales Any sale of cut products or stumpage having with
6either an estimated volume of at least 500 cord equivalents or an estimated value of

1$3,000 or more at least $10,000 requires approval of the secretary and shall be by
2public sale after. Before the department may sell timber that meets the volume or
3value threshold under this subsection, it shall announce the sale through
2
4publications of a classified advertisement announcing the sale in a newspaper
5having general circulation in the county in which the timber to be sold is located.
6Sales with an estimated value of $3,000 or more requires approval by the secretary.
AB640,2 7Section 2. 28.11 (6) (b) 1. of the statutes is amended to read:
AB640,2,188 28.11 (6) (b) 1. Any sale of timber sale with either an estimated volume of at
9least 500 cord equivalents or an estimated
value of $3,000 or more at least $10,000
10from a county forest requires approval of the secretary and
shall be by sealed bid or
11public sale after. Before a county may sell timber that meets the volume or value
12threshold under this subdivision, it shall announce the sale through
publication of
13a classified advertisement announcing the sale in a newspaper having general
14circulation in the county in which the timber to be sold is located. Any sale of timber
15sale from a county forest with either an estimated volume below 500 cord equivalents
16or an estimated
value below $3,000 $10,000 may be made without prior advertising.
17Any timber sale with an estimated value of $3,000 or more requires approval of the
18secretary.
AB640,3 19Section 3. 28.22 of the statutes is amended to read:
AB640,3,3 2028.22 Timber sales; community forests. Any sale of timber sale from a
21community forest shall be based on the scale, measure, or count of the cut products.
22Any sale of timber sale with either an estimated volume of at least 500 cord
23equivalents or an estimated
value of $3,000 or more at least $10,000 from a
24community forest
shall be by public sale after . Before a city, village, town, or school
25district may sell timber from a community forest that meets the volume or value

1threshold under this section, it shall announce the sale through
2 publications of a
2classified advertisement announcing the sale in a newspaper having general
3circulation in the county in which the timber to be sold is located.
