AB516,1,3 1An Act to amend 23.33 (11) (am) 1.; and to create 349.11 (11) of the statutes;
2relating to: authorizing posting of speed limits applicable to all-terrain
3vehicles and utility terrain vehicles.

This bill provides that a county, city, town, or village (local authority) may post
a speed limit that is applicable only to all-terrain vehicles (ATVs) and utility terrain
vehicles (UTVs).
Under current law generally, local authorities must place and maintain
standard signs giving notice of speed limits for vehicles operated on highways under
their jurisdiction. With limited exceptions, local authorities may not modify
statutorily established speed limits.
Under current law, a local authority may designate a highway under its
jurisdiction as an ATV route, subject to the requirement that the authority marks the
route with required signs. Under the bill, if a local authority designates a highway
under its jurisdiction as an ATV route, the local authority may post a speed limit,
applicable only to ATVs and UTVs that is lower than the statutorily established
speed limit for that highway.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 23.33 (11) (am) 1. of the statutes is amended to read:
AB516,2,52 23.33 (11) (am) 1. Any county, town, city, or village may enact an ordinance that
3is in strict conformity with this section and rules promulgated by the department
4under this section if the ordinance encompasses all aspects encompassed by this
5section, except as provided in subds. 2., 3., and 4. and s. 349.11 (11).
AB516,2 6Section 2. 349.11 (11) of the statutes is created to read:
AB516,2,127 349.11 (11) Notwithstanding any speed limits imposed under this section or
8under s. 346.57, if a local authority designates a highway under its jurisdiction as
9an all-terrain vehicle route under s. 23.33 (8) (b), the local authority may post a speed
10limit, applicable only to all-terrain vehicles and utility terrain vehicles, as defined
11under s. 23.33 (1) (ng), that is lower than the speed limit imposed under this section
12or under s. 346.57.
