AB442,1,2 1An Act relating to: notifying owners of residential elevators of possible defects
2and remedies.

This bill requires a person who, at any time during the previous 20 years,
manufactured, sold, constructed, installed, altered, maintained, repaired, or
inspected an elevator or dumbwaiter that serves an individual residential dwelling
unit (residential elevator) to send a notification no later than July 1, 2023, to the
owner of the dwelling unit that describes all defects of which the person is aware that
may apply to the residential elevator and a description of the remedies for the defects
of which the person is aware.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB442,1 3Section 1. Nonstatutory provisions.
AB442,1,44 (1) Definitions. In this Section:
AB442,1,55 (a) “Aware” means to have notice or knowledge.
AB442,1,66 (b) “Defect” means any of the following:
AB442,2,2
11. A defect in the manufacture, design, or installation of a residential elevator
2or any component part of a residential elevator that is related to safety.
AB442,2,6 32. A condition of a residential elevator that fails to comply with current
4standards, conditions, or specifications adopted or approved by a federal or state law
5or agency, including a requirement under subch. VII of ch. 101 or of the rules
6promulgated under subch. VII of ch. 101.
AB442,2,9 73. A repair, replacement, or alteration of a residential elevator that is
8recommended by a manufacturer, distributor, dealer, retailer, or installer of the
9residential elevator and that is related to safety.
AB442,2,11 104. A repair, replacement, or alteration of a residential elevator that is
11recommended by a consumer product safety association and that is related to safety.
AB442,2,13 125. Any other condition of a residential elevator that may pose a risk of harm
13or render the residential elevator unsafe, including any of the following:
AB442,2,16 14a. The clearance between the hoistway face of a landing door or gate for the
15residential elevator and the hoistway edge of the landing sill exceeds three-quarters
16of an inch.
AB442,2,18 17b. The distance between the hoistway face of a landing door or gate for the
18residential elevator and the farthest point of the car door or gate exceeds 3 inches.
AB442,2,1919 (c) “Elevator professional” means any of the following:
AB442,2,20 201. An elevator contractor licensed under s. 101.985 (1).
AB442,2,21 212. An elevator mechanic licensed under s. 101.985 (2).
AB442,2,22 223. An elevator inspector licensed under s. 101.985 (3).
AB442,2,23 234. A manufacturer or retailer of residential elevators.

1(d) “Residential elevator” means an elevator or dumbwaiter that serves a
2dwelling unit, as defined in s. 101.61 (1), and that is exempt under s. 101.983 (2) (e)
3from the requirements under s. 101.983 (2).
AB442,3,94 (2) Notification requirement. No later than July 1, 2023, an elevator
5professional shall send a notification to the owner of an individual residential
6dwelling unit that is served by a residential elevator that the elevator professional
7manufactured, sold, constructed, installed, altered, maintained, repaired, or
8inspected, or for which the elevator professional provided any other service, at any
9time during the previous 20 years.
AB442,3,1410 (3) Contents of notification. In a notification sent under sub. (2), an elevator
11professional shall provide the owner of an individual residential dwelling unit that
12is served by a residential elevator with a description of all defects of which the
13elevator professional is aware that may apply to the residential elevator and a
14description of the remedies for the defects of which the elevator professional is aware.
