2(1) and 946.465 (2) (title) of the statutes;
relating to: refusing or tampering
3with a global positioning system tracking device and providing a penalty.
Analysis by the Legislative Reference Bureau
Under current law, it is a Class I felony to tamper with a GPS tracking device
that is provided by the Department of Corrections to track persons who have been
convicted of certain offenses or who violate certain orders or injunctions. This bill
makes it a Class I felony to knowingly refuse, resist, or obstruct the installation of
a GPS tracking device. A Class I felony is punishable by a fine of up to $10,000 or
imprisonment of up to three years and six months, or both.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
