1An Act to create 20.115 (7) (vb) and 93.56 of the statutes;
relating to: expanding
2the clean sweep program to include collection of certain fire fighting foams and
3making an appropriation.
Analysis by the Legislative Reference Bureau
This bill requires the Department of Agriculture, Trade and Consumer
Protection to collect and store or dispose of unused fire fighting foams that contain
perfluoroalkyl or polyfluoroalkyl substances (PFAS) and that are voluntarily
surrendered. The bill allows DATCP to contract with a third party to conduct the
collection and storage or disposal. The bill requires DATCP or the third party
administering the collection program to prioritize collecting from the state and from
cities, villages, towns, and counties. Under the bill, any PFAS foams that are
collected under the program must be stored in an environmentally safe manner until
properly disposed of or treated according to DNR's administrative rules.

693.56 Fire fighting foam collection. The department shall administer a
7program to collect and store or dispose of unused fire fighting foam that contains
8perfluoroalkyl or polyfluoroalkyl substances and that was voluntarily surrendered
9by the person in possession of the foam. The department may contract with a 3rd
10party to undertake the collection and storage or disposal under this section. The
11department or the 3rd party shall give priority to collecting from the state and from
12cities, villages, towns, and counties. Fire fighting foam that is collected under this
13section shall be stored in an environmentally safe manner until properly disposed
14of or treated in accordance with any rules promulgated by the department of natural
15resources relating to the treatment and disposal of fire fighting foam.
