AB1009,1,3 An Act to create 20.455 (2) (es) and 165.97 of the statutes; relating to: grants for pretrial release monitoring and accountability programs and making an appropriation.

Analysis by the Legislative Reference Bureau

Under this bill, the Department of Justice is authorized to provide up to $10,000,000 in grants to counties for programs that provide pretrial release monitoring and accountability services. Under the bill, the programs must be evidence-based and may include location monitoring, mental health treatment, substance use disorder treatment, and sobriety monitoring.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB1009,1 Section 1. 20.005 (3) (schedule) of the statutes: at the appropriate place, insert the following amounts for the purposes indicated: - See PDF for table

AB1009,2 Section 2. 20.455 (2) (es) of the statutes is created to read:

AB1009,2,4 20.455 (2) (es) Pretrial release monitoring and accountability; grant program. The amounts in the schedule for the pretrial release monitoring and accountability grant program under s. 165.97.

AB1009,3 Section 3. 165.97 of the statutes is created to read:

AB1009,2,12 165.97 Pretrial release monitoring and accountability; grant program. The department of justice shall award grants from the appropriation under s. 20.455 (2) (es) to counties for pretrial release monitoring and accountability programs. Programs funded under this section must use evidence-based practices to provide services for individuals released from custody under ch. 969, and may include location monitoring, mental health treatment, substance use disorder treatment, and sobriety monitoring.

AB1009,4 Section 4 . Fiscal changes.

AB1009,3,2 (1) Special education aid. In the schedule under s. 20.005 (3) for the appropriation to the department of public instruction under s. 20.255 (2) (b), the dollar amount is increased by $3,100,000 for the 2021-22 fiscal year to increase funding for aids for special education under s. 115.88. In the schedule under s. 20.005 (3) for the appropriation to the department of public instruction under s. 20.255 (2) (b), the dollar amount is increased by $3,100,000 for the 2022-23 fiscal year to increase funding for aids for special education under s. 115.88.

AB1009,3,10 (2) UW System, general program operations. In the schedule under s. 20.005 (3) for the appropriation to the Board of Regents of the University of Wisconsin System under s. 20.285 (1) (a), the dollar amount is increased by $800,000 for the 2021-22 fiscal year to increase funding for the purpose for which the appropriation is made. In the schedule under s. 20.005 (3) for the appropriation to the Board of Regents of the University of Wisconsin System under s. 20.285 (1) (a), the dollar amount is increased by $800,000 for the 2022-23 fiscal year to increase funding for the purpose for which the appropriation is made.
