SB860,1,4 An Act to renumber and amend 230.35 (4) (c); to amend 36.11 (16); and to create 230.12 (1) (i), 230.35 (4) (a) 1s., 230.35 (4) (a) 5m. and 230.35 (4) (c) 2. of the statutes; relating to: closing state offices and not holding University of Wisconsin System classes on election days.

Analysis by the Legislative Reference Bureau

This bill designates the spring election, which is held in April each year, and general election, which occurs in November of each even-numbered year, as state holidays on which state offices other than the offices of the Elections Commission are closed. Under current law, the offices of the agencies of state government are generally closed on Saturdays, Sundays, and a total of nine state holidays. The bill also increases the number of regular paid holidays state employees receive annually from nine days to 11 days in even-numbered years and to ten days in odd-numbered years. In addition, the bill requires the Board of Regents of the University of Wisconsin (UW) System to ensure no classes are held at any UW institution on the days of the spring and general election.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SB860,1 Section 1. 36.11 (16) of the statutes is amended to read:

SB860,2,7 36.11 (16) Commencement of fall semester; election days. The board shall ensure that no fall semester classes at any institution, except medical school classes and 4th year classes at the school of veterinary medicine, commence until after September 1. The board shall ensure that no classes are held at any institution on the days of the spring election, as defined in s. 5.02 (21), and the general election, as defined in s. 5.02 (5).

SB860,2 Section 2 . 230.12 (1) (i) of the statutes is created to read:

SB860,2,13 230.12 (1) (i) Employees of the elections commission. The compensation plan shall provide one floating paid holiday for elections commission employees in each odd-numbered year, in lieu of a paid holiday under s. 230.35 (4) (c) 1., and 2 floating paid holidays for elections commission employees in each even-numbered year, in lieu of 2 paid holidays under s. 230.35 (4) (c) 2.

SB860,3 Section 3. 230.35 (4) (a) 1s. of the statutes is created to read:

SB860,2,16 230.35 (4) (a) 1s. The day of the spring election, as defined in s. 5.02 (21), except that the offices of the elections commission shall be kept open on this day.

SB860,4 Section 4. 230.35 (4) (a) 5m. of the statutes is created to read:

SB860,2,19 230.35 (4) (a) 5m. The day of the general election, as defined in s. 5.02 (5), except that the offices of the elections commission shall be kept open on this day.

SB860,5 Section 5. 230.35 (4) (c) of the statutes is renumbered 230.35 (4) (c) 1. and amended to read:

SB860,2,25 230.35 (4) (c) 1. Except as provided in the compensation plan under s. 230.12, all employees except limited term employees shall receive 9 10 paid holidays annually each odd-numbered year in addition to any other authorized paid leave, the time to be at the discretion of the appointing authorities.

SB860,6 Section 6. 230.35 (4) (c) 2. of the statutes is created to read:

SB860,3,5 230.35 (4) (c) 2. Except as provided in the compensation plan under s. 230.12, all employees except limited term employees shall receive 11 paid holidays each even-numbered year in addition to any other authorized paid leave, the time to be at the discretion of the appointing authorities.
