1An Act to amend 20.866 (1) (u); and
to create 13.48 (20e), 20.866 (2) (zcv) and
220.867 (3) (cv) of the statutes;
relating to: construction of or improvements to
3indoor, athletic or aquatic athletic facilities, granting bonding authority, and
4making an appropriation.

This bill amends the 2019-21 Authorized State Building Program to add grants
to assist in constructing or making improvements to indoor, athletic or aquatic
athletic facilities statewide. The bill authorizes $5,000,000 in general fund
supported borrowing for the grants. Each grant may not exceed $1,000,000, and each
grant recipient is required to raise nonstate funding in an amount equal to at least
50 percent of the total cost of the project for which the grant is awarded.

. 13.48 (20e) of the statutes is created to read:

(20e) Grants for construction of or improvements to athletic or
7aquatic athletic facilities. (a) The legislature finds and determines that the
1improvement of the health and well-being of residents of all ages of this state and
2the promotion of community and economic development are statewide
3responsibilities of statewide dimension. The legislature further finds and
4determines that indoor, athletic or aquatic athletic facilities provide vital
5opportunities year-round for residents of this state to improve their health and
6well-being through increased fitness and exercise and promote community and
7economic development. It is therefore in the public interest, and it is the public policy
8of this state, to assist in constructing or making improvements to such facilities.

(b) The building commission may authorize up to $5,000,000 in general fund
10supported borrowing to assist in constructing or making improvements to publicly
11or privately owned, indoor, athletic or aquatic athletic facilities in this state. The
12state funding commitment shall be in the form of a grant. Each grant may not exceed
13$1,000,000. Before considering each grant application, the building commission
14shall determine that the organization carrying out the project has secured additional
15funding for the project from nonstate revenue sources in an amount that is equal to
16at least 50 percent of the total cost of the project.

(c) If the building commission awards a grant under par. (b), and if, for any
18reason, the construction or improvements carried out with funds from the grant are
19not used as part of an indoor, athletic or aquatic athletic facility, the state shall retain
20an ownership interest in the construction or improvements equal to the amount of
21the state's grant.

(d) The building commission may not award a grant under par. (b) unless the
23department of administration has reviewed and approved plans for the project
24associated with the grant. Notwithstanding ss. 16.85 (1) and 16.855 (1m), the
1department of administration may not supervise any services or work or let any
2contract for the project. Section 16.87 does not apply to the project.

21improvement fund, a sum sufficient for the building commission to provide grants
22for construction of or improvements to indoor, athletic or aquatic athletic facilities,
23as specified in s. 13.48 (20e). The state may contract public debt in an amount not
24to exceed $5,000,000 for this purpose.

6(1) (m) that are attributable to the proceeds of obligations incurred in financing the
7construction or improvements, and to make payments under an agreement or
8ancillary arrangement entered into under s. 18.06 (8) (a).
