SB717,1,3 An Act to create 20.115 (7) (cs) and 93.56 of the statutes; relating to: expanding the clean sweep program to include collection of certain fire fighting foams and making an appropriation.

Analysis by the Legislative Reference Bureau

This bill requires the Department of Agriculture, Trade and Consumer Protection, in collaboration with the Department of Natural Resources, to collect and store or dispose of fire fighting foams that contain perfluoroalkyl or polyfluoroalkyl substances (PFAS) and that are voluntarily surrendered. The bill allows DATCP, with the advice of DNR, to contract with a third party to conduct the collection and storage or disposal. The bill requires DATCP or the third party administering the collection program to prioritize collecting from the state and from cities, villages, towns, and counties. Under the bill, any PFAS foams that are collected under the program must be stored in an environmentally safe manner until properly disposed of or treated.

SB717,2 Section 2. 20.115 (7) (cs) of the statutes is created to read:

SB717,2,3 20.115 (7) (cs) Clean sweep — fire fighting foam. As a continuing appropriation, the amounts in the schedule for fire fighting foam collection under s. 93.56.

SB717,3 Section 3. 93.56 of the statutes is created to read:

SB717,2,14 93.56 Fire fighting foam collection. The department, in cooperation with and with the assistance of the department of natural resources, shall administer a program to collect and store or dispose of fire fighting foam that contains perfluoroalkyl or polyfluoroalkyl substances and that was voluntarily surrendered by the person in possession of the foam. The department, with the advice of the department of natural resources, may contract with a 3rd party to undertake the collection and storage or disposal under this section. The department or the 3rd party shall give priority to collecting from the state and from cities, villages, towns, and counties. Fire fighting foam that is collected under this section shall be stored in an environmentally safe manner until properly disposed of or treated.
