SB45-SSA2-SA18,1,221. At the appropriate places, insert all of the following:
SB45-SSA2-SA18,1,33Section 1. 253.17 of the statutes is created to read:
SB45-SSA2-SA18,1,44253.17 Right to assisted reproductive technologies. (1) In this section:
SB45-SSA2-SA18,1,85(a) Assisted reproductive technology means any procreative procedure that
6involves the handling of human eggs, sperm, or embryos. Assisted reproductive
7technology includes in vitro fertilization, gamete intrafallopian transfer, zygote
8intrafallopian transfer, pronuclear stage transfer, and tubal embryo transfer.
SB45-SSA2-SA18,1,99(b) Health care provider has the meaning given in s. 146.81 (1).
SB45-SSA2-SA18,2,310(2) Any individual in this state may access any assisted reproductive
11technology without prohibition or unreasonable limitation or interference, and a

1health care provider has a corresponding right to provide assisted reproductive
2technology services and information or advice related to assisted reproductive
3technologies.
SB45-SSA2-SA18,2,44(3) Section 940.04 does not apply to any of the following:
SB45-SSA2-SA18,2,55(a) The receipt or provision of assisted reproductive technology services.
SB45-SSA2-SA18,2,76(b) Any promotion, encouragement, or counseling in favor of assisted
7reproductive technology.
SB45-SSA2-SA18,2,98(c) Any referral for assisted reproductive technology either directly or through
9an intermediary..
