AB50-ASA2-AA10,1,104115.28 (63) Mental health training program. (intro.) Establish a mental 5health training support program under which the department provides training on 6all of the following evidence-based strategies related to addressing mental health 7issues in schools to school district staff and, instructional staff of charter schools 8under s. 118.40 (2r) or (2x), and individuals employed by an out-of-school-time 9program on evidence-based strategies related to addressing mental health needs 10and suicide prevention in schools, including all of the following: AB50-ASA2-AA10,2,4

In the schedule under s. 20.005 (3) 2for the appropriation to the department of public instruction under s. 20.255 (1) 3(ep), the dollar amount for fiscal year 2025-26 is increased by $380,000 and the 4dollar amount for fiscal year 2026-27 is increased by $380,000.”. The 8department may request a waiver from the federal department of health and 9human services to administer a children’s behavioral health specialty managed 10care program under the Medical Assistance program. AB50-ASA2-AA10,96Section 9. 49.45 (30j) (a) 1. and 2. of the statutes are renumbered 49.45 (30j) 7(a) 2m. and 3. AB50-ASA2-AA10,108Section 10. 49.45 (30j) (a) 1m. of the statutes is created to read: AB50-ASA2-AA10,4,12949.45 (30j) (a) 1m. “Certified peer specialist” means an individual who has 10experience in the mental health and substance use services system, who is trained 11to provide support to others, and who has received peer specialist or parent peer 12specialist certification under the rules established by the department. AB50-ASA2-AA10,4,161449.45 (30j) (bm) The department shall reimburse under the Medical 15Assistance program under this subchapter any service provided by a certified peer 16specialist if the service satisfies all of the following conditions: AB50-ASA2-AA10,4,18171. The recipient of the service provided by a certified peer specialist is in 18treatment for or recovery from a mental illness or a substance use disorder. AB50-ASA2-AA10,4,20192. The certified peer specialist provides the service under the supervision of a 20competent mental health professional. AB50-ASA2-AA10,4,23213. The certified peer specialist provides the service in coordination with the 22Medical Assistance recipient’s individual treatment plan and in accordance with 23the recipient’s individual treatment goals. 14. The certified peer specialist providing the service has completed training 2requirements, as established by the department by rule, after consulting with 3members of the recovery community. AB50-ASA2-AA10,5,7549.45 (30j) (c) The department shall certify under Medical Assistance peer 6recovery coaches and certified peer specialists to provide services in accordance 7with this subsection. AB50-ASA2-AA10,5,10949.46 (2) (b) 14p. Subject to s. 49.45 (30j), services provided by a peer recovery 10coach or a certified peer specialist. AB50-ASA2-AA10,5,2112(1) Rules regarding training of certified peer specialists. The 13department of health services may promulgate the rules required under s. 49.45 14(30j) (bm) 4. as emergency rules under s. 227.24. Notwithstanding s. 227.24 (1) (a) 15and (3), the department of health services is not required to provide evidence that 16promulgating a rule under this subsection as an emergency rule is necessary for the 17preservation of the public peace, health, safety, or welfare and is not required to 18provide a finding of emergency for a rule promulgated under this subsection. 19Notwithstanding s. 227.24 (1) (c) and (2), emergency rules promulgated under this 20subsection remain in effect until January 1, 2027, or the date the permanent rules 21take effect, whichever is sooner. AB50-ASA2-AA10,6,423(1) Certified peer specialist services. In the schedule under s. 20.005 (3)
1for the appropriation to the department of health services under s. 20.435 (4) (b), 2the dollar amount for fiscal year 2026-27 is increased by $1,277,400 to provide 3coverage of certified peer specialist services under the Medical Assistance 4program.”. AB50-ASA2-AA10,6,16720.435 (2) (km) Indian mental health placement. All moneys transferred from 8the appropriation account under s. 20.505 (8) (hm) 25. The amounts in the schedule 9to reimburse an Indian tribe or band in this state or a county department for 10placements by a tribal court of a member of the Indian tribe or band that are 11unexpected or that result in cumulative costs of placements to the tribe or county 12department exceeding $50,000 annually. All moneys transferred from the 13appropriation account under s. 20.505 (8) (hm) 25. shall be credited to this 14appropriation account. Notwithstanding s. 20.001 (3) (a), the unencumbered 15balance on June 30 of each year shall revert to the appropriation account under s. 1620.505 (8) (hm). The amount transferred to s. 20.435 (2) (km) shall be 19$250,000 or the amount remaining in this appropriation after all other transfers 20under subds. 1c. to 24. are made, whichever is less the amount in the schedule 21under s. 20.435 (2) (km).”.
