TO SENATE BILL 330

SB330-SA6,1,11 At the locations indicated, amend the bill as follows:
SB330-SA6,1,2 21. Page 1, line 6: delete “and" and substitute “, pupil discrimination,".
SB330-SA6,1,3 32. Page 1, line 7: after “districts" insert “, and providing a penalty".
SB330-SA6,1,4 43. Page 3, line 13: after that line insert:
SB330-SA6,1,5 5 Section 2m. 118.13 (1) of the statutes is amended to read:
SB330-SA6,1,136 118.13 (1) Except as provided in s. 120.13 (37m), no person may be denied
7admission to any public school, including a charter school authorized under s. 118.40
8(2r) or (2x), or a private school participating in a program under s. 115.7915, 118.60,
9or 119.23,
or be denied participation in, be denied the benefits of or be discriminated
10against in any curricular, extracurricular, pupil services, recreational or other
11program or activity because of the person's sex, race, religion, national origin,
12ancestry, creed, pregnancy, marital or parental status, sexual orientation or
13physical, mental, emotional or learning disability.

1Section 2n. 118.13 (2) (a) of the statutes is amended to read:
SB330-SA6,2,92 118.13 (2) (a) Each school board, operator of a charter school authorized under
3s. 118.40 (2r) or (2x), and governing body of a private school participating in a
4program under s. 115.7915, 118.60, or 119.23
shall develop written policies and
5procedures to implement this section and submit them to the state superintendent
6as a part of its 1986 annual report under s. 120.18
. The policies and procedures shall
7provide for receiving and investigating complaints by residents of the school district
8regarding possible violations of this section, for making determinations as to
9whether this section has been violated and for ensuring compliance with this section.
SB330-SA6,2p 10Section 2p. 118.13 (3) (a) 3. of the statutes is amended to read:
SB330-SA6,2,1411 118.13 (3) (a) 3. Include in the department's biennial report under s. 15.04 (1)
12(d) information on the status of school district compliance with this section and
13school district progress toward providing reasonable equality of educational
14opportunity for all pupils in this state.
SB330-SA6,2q 15Section 2q. 118.13 (3) (b) 1. of the statutes is amended to read:
SB330-SA6,2,2016 118.13 (3) (b) 1. Periodically review school district programs, activities and
17services to determine whether the school boards, operators of charter schools
18established under s. 118.40 (2r) or (2x), and governing bodies of private schools
19participating in a program under s. 115.7915, 118.60, or 119.23
are complying with
20this section.

25providing information and technical assistance upon request.

1Section 2s. 118.13 (4) of the statutes is amended to read:
SB330-SA6,3,52 118.13 (4) Any public school or private school official, employee or teacher who
3intentionally engages in conduct which discriminates against a person or causes a
4person to be denied rights, benefits or privileges, in violation of sub. (1), may be
5required to forfeit not more than $1,000.”.
