TO ASSEMBLY JOINT RESOLUTION 134

AJR134-ASA1,1,4 1To create section 7 of article III of the constitution; relating to: prohibiting state
2and local governments from using private resources in connection with the
3conduct of elections and specifying who may perform tasks related to the
4conduct of an election (first consideration).
Analysis by the Legislative Reference Bureau
This constitutional amendment, proposed to the 2021 legislature on first
consideration, provides that no state agency or officer or employee in state
government and no political subdivision of the state or officer or employee of a
political subdivision may apply for, accept, or expend any donation or grant of private
resources in connection with the conduct of any primary, election, or referendum.
The constitutional amendment also prohibits any individual other than an election
official designated by law from performing any task in the conduct of any primary,
election, or referendum.
A constitutional amendment requires adoption by two successive legislatures
and ratification by the people before it can become effective.
AJR134-ASA1,1,5 5Resolved by the assembly, the senate concurring, That:
AJR134-ASA1,1 6Section 1. Section 7 of article III of the constitution is created to read:

1[Article III] Section 7 (1) No state agency or officer or employee in state
2government and no political subdivision of the state or officer or employee of a
3political subdivision may apply for, accept, or expend any donation or grant of private
4resources in connection with the conduct of any primary, election, or referendum.
AJR134-ASA1,2,65 (2) No individual other than an election official designated by law may perform
6any task in the conduct of any primary, election, or referendum.
AJR134-ASA1,2 7Section 2. Numbering of new provision. If another constitutional
8amendment ratified by the people creates the number of any provision created in this
9joint resolution, the chief of the legislative reference bureau shall determine the
10sequencing and the numbering of the provisions whose numbers conflict.
AJR134-ASA1,2,13 11Be it further resolved, That this proposed amendment be referred to the
12legislature to be chosen at the next general election and that it be published for three
13months previous to the time of holding such election.
