ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 700

AB700-AA1,1,1 At the locations indicated, amend the bill as follows:

AB700-AA1,1,2 1. Page 1, line 4: before that line insert:

AB700-AA1,1,3 “ Section 1b. 77.51 (1e) of the statutes is created to read:

AB700-AA1,1,8 77.51 (1e) “Breast pump” means an electrically or manually controlled pump device designed or marketed to be used to express milk from a human breast during lactation. “Breast pump” includes the electrically or manually controlled pump device and a battery, alternating current adapter, or power supply unit packaged and sold with the pump device at the time of sale to power the pump device.

AB700-AA1,1c Section 1c. 77.51 (1eb) of the statutes is created to read:

AB700-AA1,1,13 77.51 (1eb) (a) “Breast pump collection and storage supplies” means items of tangible personal property designed or marketed to be used in conjunction with a breast pump to collect milk expressed from a human breast and to store collected milk until it is ready for consumption.

AB700-AA1,2,7 (b) “Breast pump collection and storage supplies” includes breast shields and breast shield connectors; breast pump tubes and tubing adapters; breast pump valves and membranes; backflow protectors and backflow protector adapters; breast bottles and bottle caps specific to the operation of the breast pump; breast milk storage bags; and other items that may be useful to initiate, support, or sustain breastfeeding using a breast pump during lactation, that may be sold separately, but are generally sold as part of a breast pump kit.

AB700-AA1,2,10 (c) “Breast pump collection and storage supplies” does not include any of the following, unless sold as part of a breast pump kit prepackaged by the breast pump manufacturer or distributor:

AB700-AA1,2,11 1. Bottles and bottle caps not specific to the operation of the breast pump.

AB700-AA1,2,13 2. Breast pump travel bags and other similar carrying accessories, including ice packs, labels, and other similar products.

AB700-AA1,2,14 3. Breast pump cleaning supplies.

AB700-AA1,2,15 4. Nursing bras, bra pads, breast shells, and other similar products.

AB700-AA1,2,17 5. Creams, ointments, and other similar products that relieve breastfeeding-related symptoms or conditions of the breasts or nipples.

AB700-AA1,1d Section 1d. 77.51 (1ef) of the statutes is created to read:

AB700-AA1,2,24 77.51 (1ef) “Breast pump kit” means a kit that contains a breast pump and breast pump collection and storage supplies or other taxable items of tangible personal property that may be useful to initiate, support, or sustain breastfeeding using a breast pump during lactation, if the sales price of the other taxable items of tangible personal property sold as part of the kit at the time of sale is less than 10 percent of the total sales price of the breast pump kit.”.

AB700-AA1,3,1 2. Page 3, line 2: delete “storage" and substitute “collection".

AB700-AA1,3,4 3. Page 3, line 3: delete that line and substitute “storage supplies. The exemption under this subsection does not apply to sales and purchases that occur after June 30, 2025.”.
