AB68-SA5,1,3 31. Page 294, line 2: after that line insert:
AB68-SA5,1,4 4 Section 235m. 49.688 (11) of the statutes is amended to read:
AB68-SA5,2,25 49.688 (11) The department shall request from the federal secretary of health
6and human services a waiver, under 42 USC 1315 (a), of federal medicaid laws
7necessary to permit the department of health services to conduct a project, under all
8of the requirements of this section, to expand eligibility for medical assistance, for
9purposes of receipt of prescription drugs as a benefit, to include individuals who are
10eligible under sub. (2). The department may implement a waiver requested under
11this subsection only if the conditions of the waiver are consistent with the
12requirements of this section. The department shall implement the program under

1this section regardless of whether a waiver, as specified in this subsection, is received
2or extended

AB68-SA5,2,7 4(7u) SeniorCare permanence. Before the expiration of the current waiver, the
5department of health services shall request from the federal secretary of health and
6human services a waiver of federal law to continue permanently the prescription
7drug assistance program for elderly persons under s. 49.688.”.
