ASSEMBLY AMENDMENT 1, TO ASSEMBLY BILL 239

AB239-AA1,1,1 At the locations indicated, amend the bill as follows:

AB239-AA1,1,3 1. Page 1, line 4: delete the material beginning with that line and ending with page 2, line 5, and substitute:

AB239-AA1,1,4 “196.504 (2g) (a) In this subsection:

AB239-AA1,1,7 1. “American Rescue Plan Act funds” means moneys the governor accepts from from the federal government pursuant to section 602 of the federal Social Security Act as amended by the federal American Rescue Plan Act of 2021, P.L. 117-2.

AB239-AA1,1,10 2. “Federal telecommunications infrastructure funds” means moneys the governor accepts from the federal government, other than American Rescue Plan Act funds, that federal law authorizes to be used for telecommunications infrastructure.

AB239-AA1,2,7 (b) 1. If the governor accepts federal telecommunications infrastructure funds under s. 16.54, the governor shall allocate $600,000,000 of the federal telecommunications infrastructure funds accepted, or the total amount of federal telecommunications infrastructure funds accepted, whichever is less, for making broadband expansion grants under sub. (2). If by July 1, 2022, the governor accepts less than $600,000,000 in federal telecommunications infrastructure funds under s. 16.54, the governor shall allocate American Rescue Plan Act funds accepted under s. 16.54 for making broadband expansion grants under sub. (2) in an amount such that the total amount of federal funds allocated under this subdivision is $600,000,000.

AB239-AA1,2,10 2. If the governor accepts more than $600,000,000 in federal telecommunications infrastructure funds under s. 16.54, the governor shall allocate the moneys received in excess of $600,000,000 for the following purposes:

AB239-AA1,2,12 a. Enhancing cellular connectivity and service along state trunk highways and interstate highways.

AB239-AA1,2,14 b. Making grants to cities, villages, towns, or counties with a population of at least 10,000 for enhancing broadband or cellular connectivity and productivity.

AB239-AA1,2,17 (c) Notwithstanding par. (b), the governor is not required to allocate federal funds under par. (b) if federal law does not authorize allocating the funds for those purposes.”.
