1. “American Rescue Plan Act funds” means moneys the governor accepts from

2. “Federal telecommunications infrastructure funds” means moneys the
9governor accepts from the federal government, other than American Rescue Plan Act
10funds, that federal law authorizes to be used for telecommunications infrastructure.

(b) 1. If the governor accepts federal telecommunications infrastructure funds
12under s. 16.54, the governor shall allocate $600,000,000 of the federal
13telecommunications infrastructure funds accepted, or the total amount of federal
1telecommunications infrastructure funds accepted, whichever is less, for making
2broadband expansion grants under sub. (2). If by July 1, 2022, the governor accepts
3less than $600,000,000 in federal telecommunications infrastructure funds under s.
416.54, the governor shall allocate American Rescue Plan Act funds accepted under
5s. 16.54 for making broadband expansion grants under sub. (2) in an amount such
6that the total amount of federal funds allocated under this subdivision is
7$600,000,000.

2. If the governor accepts more than $600,000,000 in federal
9telecommunications infrastructure funds under s. 16.54, the governor shall allocate
10the moneys received in excess of $600,000,000 for the following purposes:

a. Enhancing cellular connectivity and service along state trunk highways and
12interstate highways.

b. Making grants to cities, villages, towns, or counties with a population of at
14least 10,000 for enhancing broadband or cellular connectivity and productivity.

(c) Notwithstanding par. (b), the governor is not required to allocate federal
16funds under par. (b) if federal law does not authorize allocating the funds for those
17purposes.”.
