AB653-ASA2,1,2 An Act to create 302.389 of the statutes; relating to: providing medication and a valid prescription to a prisoner upon release.

Under this bill, the Department of Corrections must identify whether any individual who is about to be released from prison is currently taking a prescription medication. If an individual is taking a prescription medication, DOC must provide to the individual at the time of his or her release a four-week or 30-day supply of the medication and a valid prescription to obtain eight weeks or 60 days worth of medication to be filled at a later date, provided the department prescriber determines that the medications and quantities are clinically appropriate.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB653-ASA2,1 Section 1 . 302.389 of the statutes is created to read:

AB653-ASA2,2,7 302.389 Medication and prescription provided upon release. Before an individual is released from confinement in prison upon completion of his or her sentence or to parole or extended supervision, the department shall determine if the individual is currently taking a prescription medication. If the individual is taking a prescription medication, the department shall provide to the individual at the time of his or her release a 4-week or 30-day supply of the medication and a valid prescription to obtain 8 weeks or 60 days worth of medication to be filled at a later date, provided that a department prescriber determines that the medications and quantities are clinically appropriate.
