AB443-AA2,1,11 At the locations indicated, amend the bill as follows:
AB443-AA2,1,2 21. Page 2, line 9: delete “shall" and substitute “may".
AB443-AA2,1,3 32. Page 2, line 10: after “if" insert “the grant is awarded and if".
AB443-AA2,1,5 43. Page 2, line 12: after “hospital that" insert “applies to the building
5commission and".
AB443-AA2,1,6 64. Page 2, line 24: after that line insert:
AB443-AA2,1,9 73. The hospital identifies measures that it believes will serve the needs of area
8residents with mental health needs, especially, as a critical component of the
9measures, in reducing the burden on the Winnebago Mental Health Institute.
AB443-AA2,1,13 104. The hospital agrees to annually report to the legislature, in the manner
11described under s. 13.172 (2), the services provided with the resources funded by the
12grant awarded under this subsection, including the number of individuals diverted
13from the Winnebago Mental Health Institute.

15. The hospital recognizes that it is liable to repay the grant funds to the state
2if the hospital fails to continue to maintain the expanded services and number of
3expanded psychiatric beds available. The amount the hospital is liable for
4repayment is reduced proportionately each year for 10 years of continuing expanded
5services as described under par. (bg).
AB443-AA2,2,7 6(bg) A determination of continued services shall be based on findings that the
7hospital does all of the following:
AB443-AA2,2,12 81. Maintains an agreed upon number of beds for acceptance of admissions for
9emergency detention under s. 51.15. A hospital is considered to be in compliance
10with this subdivision if at least half of the expanded psychiatric beds under par. (b)
112. are available for individuals who are initially admitted under an emergency
12detention under s. 51.15.
AB443-AA2,2,14 132. Enters into a contract with, at minimum, two-thirds of the counties specified
14in par. (b) 2. in which the hospital agrees to do all of the following:
AB443-AA2,2,16 15a. Be the primary receiver for individuals under an emergency detention under
16s. 51.15 for the county.
AB443-AA2,2,18 17b. Accept for admission under an emergency detention individuals regardless
18of payment source.
AB443-AA2,2,21 19c. Accept any individual subject to an emergency detention from the county
20unless all psychiatric beds added under par. (b) 2. are filled. The hospital may set
21its payment rate based on the acuity of the individual being detained.
AB443-AA2,2,23 22d. Ensure the county department is the secondary payer after any other
23coverage the individual has is exhausted.”.
