Certification List Request
I request certification for the following case types (check all that apply):
⬜ Trial 2 — Class G, H and I felonies: The attorney has been trial counsel, alone or with other trial counsel in the five years immediately preceding this request; and has litigated a significant portion of one completed jury trial, or two trials to a court of record, or four testimonial hearings before a court of record, but not including a proceeding to revoke probation, parole or extended supervision. Wis. Admin. Code s. PD 1.04 (3) (a). ⬜ Trial 3 — Class D, E and F felonies: In the five years immediately preceding this request, the attorney has either been sole trial counsel in at least one felony case tried to a jury to final resolution; or has been trial counsel, alone or with another attorney, and litigated a significant portion of three civil or criminal cases tried to a jury to final resolution. Wis. Admin. Code s. PD 1.04 (3) (b). ⬜ Trial 3B — Class B and C felonies, Chapter 980 commitments: In the five years immediately preceding this request,, the attorney has been sole trial counsel in at least four cases tried to a jury to final resolution, at least one of which was a felony. Wis. Admin. Code s. PD 1.04 (3) (c) and (6). ⬜ Trial Special 2A — Ch. 938 juvenile delinquency (Class E, F, G, H, I felonies): The attorney is certified for Trial Special 2 cases (ch. 48 children in need of protection or services and ch. 938 juvenile delinquency/misdemeanor cases) and satisfies the certification criteria for Trial 2 cases. Wis. Admin. Code s. PD 1.04 (8). ⬜ Trial Special 2B — Ch. 938 juvenile delinquency (Class B, C, D felonies): The attorney satisfies the certification criteria for Trial 3 cases and has been sole trial counsel in at least three trials to the court in ch. 938, Stats., cases in which the most serious allegation would be a felony if prosecuted in criminal court. Wis. Admin. Code s. PD 1.04 (9). ⬜ Trial Special 3 — Termination of Parental Rights: The attorney satisfies the certification criteria for Trial 2 cases, has completed four credits of state public defender approved legal education pertaining to ch. 48, Stats., and four credits of state public defender approved legal education pertaining to termination of parental rights cases. Wis. Admin. Code s. PD 1.04 (10). ⬜ Trial Special 4B — Revocation of (felony) probation, parole or extended supervision: The attorney satisfies the certification criteria for Trial 2 cases and has completed two credits of state public defender approved legal education pertaining to revocation. Wis. Admin. Code s. PD 1.04 (12) (b). Provide documentation to verify your participation in the trials and hearings that satisfy the certification requirement(s) applicable to your request. Case names, numbers, and jurisdictions are necessary for verification. If the trials or hearings are from outside Wisconsin, you must provide copies of court documents.
