NR 440.75(9)(e) (e) Each owner or operator subject to the provisions of this section shall keep up-to-date, readily accessible records of the installation date and location of all newly installed collectors as specified under sub. (6) (b).
NR 440.75(9)(f) (f) Each owner or operator subject to the provisions of this section shall keep readily accessible documentation of the nature, date of deposition, amount and location of asbestos-containing or nondegradable waste excluded from collection as provided in sub. (10) (a) 3. a. as well as any nonproductive areas excluded from collection as provided in sub. (10) (a) 3. b.
NR 440.75(9)(g) (g) Except as provided in sub. (3) (b) 2. a. 2), each owner or operator subject to the provisions of this section shall keep for at least 5 years up-to-date, readily accessible records of all collection and control system exceedances of the operational standards in sub. (4), the reading in the subsequent month whether or not the second reading is an exceedance, and the location of each exceedance.
NR 440.75(9)(h) (h) Landfill owners or operators who convert design capacity from volume to mass or mass to volume to demonstrate that landfill design capacity is less than 2.5 million megagrams or 2.5 million cubic meters, as provided in the definition of “design capacity", shall keep readily accessible, on-site records of the annual recalculation of site-specific density, design capacity, and the supporting documentation. Off-site records may be maintained if they are retrievable within 4 hours. Either paper copy or electronic formats are acceptable.
NR 440.75(10) (10)Specifications for active collection systems.
NR 440.75(10)(a)(a) Each owner or operator seeking to comply with sub. (3) (b) 2. a. shall site active collection wells, horizontal collectors, surface collectors or other extraction devices at a sufficient density throughout all gas producing areas using the following procedures unless alternative procedures have been approved by the department as provided in sub. (3) (b) 2. a. 3) and 4):
NR 440.75(10)(a)1. 1. The collection devices within the interior and along the perimeter areas shall be certified to achieve comprehensive control of surface gas emissions by a professional engineer. The design for the collection system shall address depths of refuse, refuse gas generation rates and flow characteristics, cover properties, gas system expandability, leachate and condensate management, accessibility, compatibility with filling operations, integration with closure end use, air intrusion control, corrosion resistance, fill settlement and resistance to the refuse decomposition heat.
NR 440.75(10)(a)2. 2. The sufficient density of gas collection devices determined in subd. 1. shall address landfill gas migration issues and augmentation of the collection system through the use of active or passive systems at the landfill perimeter or exterior.
NR 440.75(10)(a)3. 3. The placement of gas collection devices determined in subd. 1. shall control all gas producing areas, except as follows:
NR 440.75(10)(a)3.a. a. Any segregated area of asbestos or nondegradable material may be excluded from collection if documented as provided under sub. (9) (f). The documentation shall provide the nature, date of deposition, location and amount of asbestos or nondegradable material deposited in the area, and shall be provided to the department upon request.
NR 440.75(10)(a)3.b. b. Any nonproductive area of the landfill may be excluded from control, provided that the total of all excluded areas can be shown to contribute less than 1% of the total amount of NMOC emissions from the landfill. The amount, location and age of the material shall be documented and provided to the department upon request. A separate NMOC emissions estimate shall be made for each section proposed for exclusion, and the sum of all the sections shall be compared to the NMOC emissions estimate for the entire landfill. Emissions from each section shall be computed using the following equation:

Qi is the NMOC emission rate from the ith section in megagrams per year
k is the methane generation rate constant in year-1
Lo is the methane generation potential in cubic meters per megagram of solid waste
Mi is the mass of the degradable solid waste in the ith section in megagram
ti is the age of the solid waste in the ith section in years
CNMOC is the concentration of nonmethane organic compounds in parts per million by volume

NR 440.75(10)(a)4. 4. When calculating emissions using the equation in subd. 3. b., the values for k and CNMOC determined in field testing shall be used if field testing has been performed in determining the NMOC emission rate or the radii of influence (the distance from the well center to a point in the landfill where the pressure gradient applied by the blower or compressor approaches zero). If field testing has not been performed, the default values for k, Lo and CNMOIC provided in sub. (5) (a) 1. or the alternative values from sub. (5) (a) 5. shall be used. The mass of nondegradable solid waste contained within the given section may be subtracted from the total mass of the section when estimating emissions provided the nature, location, age and amount of the nondegradable material is documented as provided in subd. 3. a.
NR 440.75(10)(b) (b) Each owner or operator seeking to comply with sub. (3) (b) 2. a. 1) shall construct the gas collection devices using the following equipment or procedures:
NR 440.75(10)(b)1. 1. The landfill gas extraction components shall be constructed of polyvinyl chloride, high density polyethylene pipe, fiberglass, stainless steel or other nonporous corrosion resistant material of suitable dimensions to convey projected amounts of gases; withstand installation, static and settlement forces; and withstand planned overburden or traffic loads. The collection system shall extend as necessary to comply with emission and migration standards. Collection devices such as wells and horizontal collectors shall be perforated to allow gas entry without head loss sufficient to impair performance across the intended extent of control. Perforations shall be situated with regard to the need to prevent excessive air infiltration.
NR 440.75(10)(b)2. 2. Vertical wells shall be placed so as not to endanger underlying liners and shall address the occurrence of water within the landfill. Holes and trenches constructed for piped wells and horizontal collectors shall be of sufficient cross-section so as to allow for their proper construction and completion including, for example, centering of pipes and placement of gravel backfill. Collection devices shall be designed so as not to allow indirect short circuiting of air into the cover or refuse into the collection system or gas into the air. Any gravel used around pipe perforations should be of a dimension so as not to penetrate or block perforations.
NR 440.75(10)(b)3. 3. Collection devices may be connected to the collection header pipes below or above the landfill surface. The connector assembly shall include a positive closing throttle valve, any necessary seals and couplings, access couplings and at least one sampling port. The collection devices shall be constructed of polyvinyl chloride, high density polyethylene, fiberglass, stainless steel or other nonporous material of suitable thickness.
NR 440.75(10)(c) (c) Each owner or operator seeking to comply with sub. (3) (b) 2. a. 1) shall convey the landfill gas to a control system, in compliance with sub. (3) (b) 2. c., through the collection header pipes. The gas mover equipment shall be sized to handle the maximum gas generation flow rate expected over the intended use period of the gas moving equipment using the following procedures:
NR 440.75(10)(c)1. 1. For existing collection systems, the flow data shall be used to project the maximum flow rate. If no flow data exists, the procedures in subd. 2. shall be used.
NR 440.75(10)(c)2. 2. For new collection systems, the maximum flow rate shall be in accordance with sub. (6) (a) 1.

NR 440.76 NR 440.76Small municipal waste combustion units for which construction is commenced after August 30, 1999 or for which modification or reconstruction is commenced after June 6, 2001. This section establishes new source performance standards for new small municipal waste combustion units. Some of the requirements in this section apply during municipal waste combustion unit planning and shall be completed before construction is commenced on the municipal waste combustion unit. In particular, the preconstruction requirements in subs. (3) and (4) shall be completed prior to commencing construction. Other requirements, such as the emission limits, apply when the municipal waste combustion unit begins operation.
NR 440.76 Note Note: For purposes of this section “I", "my", “you" or “your", refers to the owner or operator of a municipal waste combustion unit or the applicant for a permit to construct a municipal waste combustion unit, unless the context indicates otherwise. (See the definitions in sub. (2) (z) and (zm).)
NR 440.76(1) (1)Applicability.
NR 440.76(1)(a)(a) Does this section apply to my municipal waste combustion unit? This section applies if your municipal waste combustion unit meets the following 2 criteria:
NR 440.76(1)(a)1. 1. Your municipal waste combustion unit is a new municipal waste combustion unit.
NR 440.76(1)(a)2. 2. Your municipal waste combustion unit has the capacity to combust at least 35 tons per day but no more than 250 tons per day of municipal solid waste or refuse-derived fuel.
NR 440.76(1)(b) (b) What is a new municipal waste combustion unit?
NR 440.76(1)(b)1.1. A new municipal waste combustion unit is a municipal waste combustion unit that meets either of the following 2 criteria:
NR 440.76(1)(b)1.a. a. Commenced construction after August 30, 1999.
NR 440.76(1)(b)1.b. b. Commenced reconstruction or modification after June 6, 2001.
NR 440.76(1)(b)2. 2. This section does not apply to your municipal waste combustion unit if you make physical or operational changes to an existing municipal waste combustion unit primarily to comply with the emission guidelines in subpart BBBB of 40 CFR part 60. Those changes do not qualify as reconstruction or modification under this section.
NR 440.76(1)(c) (c) Does this section allow any exemptions?
NR 440.76(1)(c)1.1. `Small municipal waste combustion units that combust less than 11 tons per day.' You are exempt from this section if you meet the following 4 requirements:
NR 440.76(1)(c)1.a. a. Your municipal waste combustion unit is subject to a federally enforceable permit limiting the amount of municipal solid waste combusted to less than 11 tons per day.
NR 440.76(1)(c)1.b. b. You notify the department that the unit qualifies for the exemption.
NR 440.76(1)(c)1.c. c. You provide the department with a copy of the federally enforceable permit.
NR 440.76 Note Note: If the department issued the permit you may satisfy the requirement in subd. 1.c. by providing the department with your facility identification number and the number and date of issuance of the permit which limits the amount of municipal solid waste combusted.
NR 440.76(1)(c)1.d. d. You keep daily records of the amount of municipal solid waste combusted.
NR 440.76(1)(c)2. 2. `Small power production facilities.' You are exempt from this section if you meet the following 4 requirements:
NR 440.76(1)(c)2.a. a. Your unit qualifies as a small power production facility under section 3 (17) (C) of the Federal Power Act (16 USC 796 (17) (C)).
NR 440.76(1)(c)2.b. b. Your unit combusts homogeneous waste, excluding refuse-derived fuel, to produce electricity.
NR 440.76(1)(c)2.c. c. You notify the department that the unit qualifies for the exemption.
NR 440.76(1)(c)2.d. d. You provide the department with documentation that the unit qualifies for the exemption.
NR 440.76(1)(c)3. 3. `Cogeneration facilities.' You are exempt from this section if you meet the following 4 requirements:
NR 440.76(1)(c)3.a. a. Your unit qualifies as a cogeneration facility under section 3 (18) (B) of the Federal Power Act (16 USC 796 (18) (B)).
NR 440.76(1)(c)3.b. b. Your unit combusts homogeneous waste, excluding refuse-derived fuel, to produce electricity and steam or other forms of energy used for industrial, commercial, heating or cooling purposes.
NR 440.76(1)(c)3.c. c. You notify the department that the unit qualifies for the exemption.
NR 440.76(1)(c)3.d. d. You provide the department with documentation that the unit qualifies for the exemption.
NR 440.76(1)(c)4. 4. `Municipal waste combustion units that combust only tires.' You are exempt from this section if you meet the following 3 requirements:
NR 440.76(1)(c)4.a. a. Your municipal waste combustion unit combusts a single-item waste stream of tires and no other municipal waste. However, the unit can co-fire coal, fuel oil, natural gas or other nonmunicipal solid waste.
NR 440.76(1)(c)4.b. b. You notify the department that the unit qualifies for the exemption.
NR 440.76(1)(c)4.c. c. You provide the department with documentation that the unit qualifies for the exemption.
NR 440.76(1)(c)5. 5. `Hazardous waste combustion units.' You are exempt from this section if you get a permit for your unit under section 3005 of the Solid Waste Disposal Act (42 USC 6925) or a license under s. 291.25, Stats.
NR 440.76(1)(c)6. 6. `Materials recovery units.' You are exempt from this section if your unit combusts waste mainly to recover metals. Primary and secondary smelters qualify for the exemption.
NR 440.76(1)(c)7. 7. `Co-fired combustors.' You are exempt from this section if you meet the following 4 requirements:
NR 440.76(1)(c)7.a. a. Your unit has a federally enforceable permit limiting the combustion of municipal solid waste to 30% of the total fuel input by weight.
NR 440.76(1)(c)7.b. b. You notify the department that the unit qualifies for the exemption.
NR 440.76(1)(c)7.c. c. You provide the department with a copy of the federally enforceable permit.
NR 440.76 Note Note: If the department issued the permit you may satisfy the requirement in subd. 7.c. by providing the department with your facility identification number and the number and date of issuance of the permit which limits the amount of municipal solid waste combusted.
NR 440.76(1)(c)7.d. d. You record the weights, each quarter, of municipal solid waste and of all other fuels combusted.
NR 440.76(1)(c)8. 8. `Plastics or rubber recycling units.' You are exempt from this section if you meet the following 4 requirements:
NR 440.76(1)(c)8.a. a. Your pyrolysis or combustion unit is an integrated part of a plastics or rubber recycling unit as defined in sub. (2).
NR 440.76(1)(c)8.b. b. You record the weights, each quarter, of plastics, rubber and rubber tires processed.
NR 440.76(1)(c)8.c. c. You record the weights, each quarter, of feed stocks produced and marketed from chemical plants and petroleum refineries.
NR 440.76(1)(c)8.d. d. You keep the name and address of the purchaser of those feed stocks.
NR 440.76(1)(c)9. 9. `Units that combust fuels made from products of plastics or rubber recycling plants.' You are exempt from this section if you meet the following 2 requirements:
NR 440.76(1)(c)9.a. a. Your unit combusts gasoline, diesel fuel, jet fuel, fuel oils, residual oil, refinery gas, petroleum coke, liquified petroleum gas, propane or butane produced by chemical plants or petroleum refineries that use feedstocks produced by plastics or rubber recycling units.
NR 440.76(1)(c)9.b. b. Your unit does not combust any other municipal solid waste.
NR 440.76(1)(c)10. 10. `Cement kilns.' You are exempt from this section if your cement kiln combusts municipal solid waste.
NR 440.76(1)(c)11. 11. `Air curtain incinerators.' If your air curtain incinerator, as defined in sub. (2), combusts 100% yard waste, only the requirements under sub. (14) apply to you.
NR 440.76(1)(d) (d) Do the new source performance standards of s. NR 440.21 also apply to my municipal waste combustion unit? If this section applies to your municipal waste combustion unit, then s. NR 440.21 does not apply to your municipal waste combustion unit.
NR 440.76(1)(f) (f) How are these new source performance standards structured? These new source performance standards contain the following 5 major components:
