2021 WISCONSIN ACT 30
An Act to amend 115.28 (55) (title); and to create 115.28 (55m), 118.40 (2r) (b) 2. L., 118.40 (2x) (b) 2. L., 118.60 (2) (a) 9., 119.23 (2) (a) 9. and 121.02 (1) (L) 8. of the statutes; relating to: incorporating the Holocaust and other genocides into the state model social studies standards and requiring instruction on the Holocaust and other genocides.
The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

. 115.28 (55) (title) of the statutes is amended to read:
115.28 (55) (title) Social studies standards; organized labor.

. 115.28 (55m) of the statutes is created to read:
115.28 (55m) The Holocaust and other genocides; model standards, curricula, and instructional materials. (a) Incorporate the Holocaust, as defined in s. 121.02 (1) (L) 8. a., and other genocides into the model academic standards for social studies.
(b) Develop a model curriculum and related instructional materials for pupils in grades 5 to 8 on the Holocaust, as defined in s. 121.02 (1) (L) 8. a., and other genocides.
(c) Develop a model curriculum and related instructional materials for pupils in grades 9 to 12 on the Holocaust, as defined in s. 121.02 (1) (L) 8. a., and other genocides.

118.40 (2r) (b) 2. L. If the contract is for the operation of a charter school that includes a grade from 5 to 12, a requirement that the charter school's curriculum include the instruction required under s. 121.02 (1) (L) 8., so far as applicable.

7. 121.02 (1) (L) 8. of the statutes is created to read:
121.02 (1) (L) 8. a. In this subdivision, “Holocaust” means the systematic state-sponsored killing of 6 million Jewish men, women, and children and millions of others by Nazi Germany and its collaborators between 1933 and 1945.
b. By July 1, 2022, as a part of the social studies curriculum, include instruction on the Holocaust and other genocides at least once in grades 5 to 8 and at least once in grades 9 to 12.

Nonstatutory provisions.
(1) Model curricula and instructional materials. In developing the model curricula and related instructional materials required under s. 115.28 (55m) (b) and (c), the state superintendent of public instruction shall consult with all of the following:
(a) An organization in this state that is dedicated to Holocaust remembrance, Holocaust education, and the preservation of the memory of victims of the Holocaust and provides free Holocaust education programs to public and private schools and offers educational tools and training to teachers.
(b) A state agency in another state that has developed a model curriculum on the Holocaust and other genocides.

Initial applicability.
(1) Independent charter school contracts. The treatment of s. 118.40 (2r) (b) 2. L. and (2x) (b) 2. L. first applies to a contract that is entered into, renewed, or modified on the effective date of this subsection.
(2) Private schools participating in a parental choice program. The treatment of ss. 118.60 (2) (a) 9. and 119.23 (2) (a) 9. first applies to an application to attend a private school under a parental choice program in the 2022-23 school year.
