NOTICE OF PUBLIC HEARING AND COMMENT PERIOD
Emergency Rule Relating to Hemp and Affecting Small Businesses
The Wisconsin Department of Agriculture, Trade and Consumer Protection (Department) announces that, pursuant to Wis. Stat. § 227.24 (4), the Department will hold a public hearing and comment period on its emergency rule to repeal and recreate Wis. Admin. Code ch. ATCP 22, relating to hemp and affecting small businesses.
The Department will hold the public hearing at the time shown below. The hearing will be held virtually via Zoom meeting, due to the precautions adopted during the COVID-19 pandemic. The Department invites the public to participate in the public hearing on the emergency rule and to provide oral testimony. To assist the Department in preparations for the Zoom meeting, the Department requests public hearing participants to send an email to Abbey.Graf@wisconsin.gov in advance of the hearing to signal their intention to participate. This advance notice of participation is not required, but is requested to help the Department ensure adequate Zoom capacity so that all interested members of the public may participate. Depending on the level of participation, a time limit for individual public comment may be required to allow all interested parties to participate. Alternatively, written public comments may be sent to the Hemp Rule, Division of Agricultural Resource Management, Department of Agriculture, Trade and Consumer Protection, P.O. Box 8911, Madison, WI 53708-8911 or by e-mail to Abbey.Graf@wisconsin.gov. Public comments whether oral, written or emailed, carry the same weight and will be considered. The comment period will remain open until the close of business on Friday, June 11, 2021.

Initial Regulatory Flexibility Analysis
This emergency rule continues the regulatory framework of the Hemp Program as it existed under previous emergency rules with minor changes to ensure consistency with state law and to clarify rule language to reflect program practice. Therefore, the rule will not negatively impact small business as this rule does not make significant modifications to the regulation of the hemp industry as it currently exists.
