Notice of Hearing
The Department of Natural Resources announces that it will hold an online public hearing on a permanent rule to revise chs. NR 400, 419, 421, 422, 423, 425, 439, and 484, relating to implementing reasonably available control technology (RACT) to limit volatile organic compound (VOC) emissions from miscellaneous metal and plastic parts coatings and miscellaneous industrial adhesives. In accordance with s. 227.17, Wis. Stats., the DNR is seeking public comment and feedback on the rule at the time and virtual location shown below. The public hearing concerns the proposed revision of Wisconsin’s State Implementation Plan (SIP) developed under s. 285.11(6), Stats. Final rules affecting chs. NR 400, 419, 421, 422, 423, 425, 439, and 484, Wis. Adm. Code, promulgated under this rulemaking will be submitted to the United States Environmental Protection Agency (EPA) for approval and incorporation into Wisconsin’s SIP. This public hearing notice and request for comments satisfies requirements in ch. 227, Wis. Stats., for rulemaking and 40 CFR Part 51.102 for submittal of the final rules to EPA as a revision to Wisconsin’s SIP.

The department is proposing to update its existing VOC RACT regulations to reflect the latest EPA CTGs Miscellaneous Metal and Plastic Parts Coatings (MMPPC) CTG and the Miscellaneous Industrial Adhesives (Adhesives) CTG issued in 2008. This will ensure the state remains in compliance with Clean Air Act (CAA) Section 182(b)(2) requirements as they apply to moderate and higher ozone nonattainment areas. Wisconsin’s compliance with all CAA requirements, including ensuring compliance with up-to-date RACT rules, will ensure the state has a legally sufficient state implementation plan (SIP) and allow the state to redesignate eligible ozone nonattainment areas more quickly.

Comments on the proposed rule must be received on or before February 1, 2021. Initial Regulatory Flexibility Analysis
The RACT control requirements in the proposed rule could have an economic cost to some individual small businesses. The DNR anticipates that the total cost to small businesses as a result of this rule will be approximately $13,440.
