NOTICE OF PUBLIC HEARING
CHAPTER PI 30
SPECIAL EDUCATION AID
NOTICE IS HEREBY GIVEN that pursuant to s. 227.11 (2) (a) (intro.), Stats., and interpreting s. 115.881, Stats., the Department of Public Instruction will hold a public hearing as required under s. 227.16, Stats., to consider the promulgation of a proposed permanent rule amending PI 30 relating to clarifying high cost special education aid. The hearing will be held as follows:
Date and Time: Friday, December 20, 2019, from 1:30 p.m. – 3:00 p.m.
Location: GEF 3 Building, Room 041, 125 S Webster St., Madison, WI 53703
The proposed rule seeks to provide clarity in determining costs for providing special education related services to a child for the purpose of receiving high cost special education aid. The areas clarified by this rule are as follows: 1) determining nonadministrative costs for providing special education and related services to a child, distinct from such costs for other children; 2) determining how equipment and other capital costs are considered in the context of “the previous school year” as given in s. 115.881 (1), Stats.; 3) clarifying what is meant by “federal medicaid,” as given in s. 115.881 (1), Stats., for the purpose of determining claims under the program; and 4) determining how the $30,000 threshold for special education costs is evaluated against the other funding sources listed in statute.

Appearances at the Hearing and Submittal of Written Comments
Interested persons are invited to appear at the hearing and will be afforded the opportunity to make a presentation of their position on the proposed rule orally or in writing. The purpose of this hearing to consider public testimony on the proposed rules under consideration. Questions or comments about the rules under consideration may be posed and will be duly recorded.
Individuals who are unable to attend the hearing but would like to submit written comments may do so via the Department’s form for submitting comment at https://forms.gle/CK6qrZ5iziTUgQjb9. Questions or additional testimony may be accepted by using the contact information below. Written comments on the proposed rules received no later than January 3, 2020, will be given the same consideration as testimony presented at the hearing.
