On October 30, 2018, the Wisconsin Department of Revenue submitted a proposed rule to the Wisconsin Legislative Council Rules Clearinghouse.
The scope statement for this rule, SS 014-17, was approved by the Governor on January 23, 2017, published in Register No. 733B on January 30, 2017, and approved by the Secretary of Revenue on February 10, 2017.
Analysis
The rule clarifies the level of activity and/or types of activities that, when performed by an out-of-state business, establishes nexus in Wisconsin and requires the filing of a Wisconsin income/franchise tax return.
Agency Procedure for Promulgation
A public hearing on the proposed rule is required and will be scheduled.
The Office of the Secretary is primarily responsible for the promulgation of the proposed rule.
