The Department of Natural Resources announces that it will hold a public hearing on a permanent rule to revise ch. NR 149, relating to the WDNR accreditation of laboratories that submit data to the Department under covered programs, at the time and place shown below.

Initial Regulatory Flexibility Analysis: This rule will result in a minor impact on small businesses based on our proposal to remove the cap on fees. The current fee structure includes a cap on fees for those laboratories that perform a large number of analytical methods. This structure does not account for the relative workload required to audit laboratories that perform a large number of analytical methods. As a result, this proposal removes the cap so that the inspection fees are more proportional to the actual work effort.
Currently 351 laboratories are accredited by this program. Of those 351 laboratories, 25 laboratories (7%) are small businesses that will see a fee increase if the cap is removed. The average fee increase for the 25 laboratories that will be affected by removing the cap is $875 per laboratory. The other 326 laboratories in the program will see a decrease in fees; the average fee reduction will be $81 per laboratory.
