TO SENATE BILL 21

SB21-AA1,1,21 At the locations indicated, amend the bill, as shown by senate substitute
2amendment 1, as follows:
SB21-AA1,1,3 31. At the appropriate places, insert all of the following:
SB21-AA1,1,4 4" Section 1. 49.45 (23) (a) of the statutes is amended to read:
SB21-AA1,1,125 49.45 (23) (a) The department shall request a waiver from the secretary of the
6federal department of health and human services to permit the department to
7conduct a demonstration project to provide health care coverage to adults who are
8under the age of 65, who have family incomes not to exceed 100 133 percent of the
9poverty line before application of the 5 percent income disregard under 42 CFR
10435.603 (d)
, except as provided in s. 49.471 (4g), and who are not otherwise eligible
11for medical assistance under this subchapter, the Badger Care health care program
12under s. 49.665, or Medicare under 42 USC 1395 et seq.
SB21-AA1,2 13Section 2. 49.471 (1) (cr) of the statutes is created to read:

149.471 (1) (cr) "Enhanced federal medical assistance percentage" means a
2federal medical assistance percentage described under 42 USC 1396d (y) or (z).
SB21-AA1,3 3Section 3. 49.471 (4) (a) 4. b. of the statutes is amended to read:
SB21-AA1,2,64 49.471 (4) (a) 4. b. The Except as provided in sub. (4g), the individual's family
5income does not exceed 100 133 percent of the poverty line before application of the
65 percent income disregard under 42 CFR 435.603 (d)

SB21-AA1,4 7Section 4. 49.471 (4g) of the statutes is created to read:
SB21-AA1,2,158 49.471 (4g) Medicaid expansion; federal medical assistance percentage. (a)
9For services provided to individuals described under sub. (4) (a) 4. and s. 49.45 (23),
10the department shall comply with all federal requirements to qualify for the highest
11available enhanced federal medical assistance percentage. The department shall
12submit any amendment to the state medical assistance plan, request for a waiver of
13federal Medicaid law, or other approval required by the federal government to
14provide services to the individuals described under sub. (4) (a) 4. and s. 49.45 (23) and
15qualify for the highest available enhanced federal medical assistance percentage.
SB21-AA1,3,216 (b) If the department does not qualify for an enhanced federal medical
17assistance percentage, or if the enhanced federal medical assistance percentage
18obtained by the department is lower than printed in federal law as of July 1, 2013,
19for individuals eligible under sub. (4) (a) 4. or s. 49.45 (23), the department shall
20submit to the joint committee on finance a fiscal analysis comparing the cost to
21maintain coverage for adults who are not pregnant and not elderly at up to 133
22percent of the poverty line to the cost of limiting eligibility to those adults with family
23incomes up to 100 percent of the poverty line. The department may reduce income
24eligibility for adults who are not pregnant and not elderly from up to 133 percent of

1the poverty line to up to 100 percent of the poverty line only if this reduction in income
2eligibility levels is approved by the joint committee on finance.
SB21-AA1,5 3Section 5. 121.905 (3) (c) 5g. of the statutes is created to read:
SB21-AA1,3,54 121.905 (3) (c) 5g. For the limit for the 2015-16 school year and the 2016-17
5school year, add $150 to the result under par. (b).
SB21-AA1,6 6Section 6. 121.905 (3) (c) 6. of the statutes is amended to read:
SB21-AA1,3,97 121.905 (3) (c) 6. For the limit for the 2015-16 2017-18 school year or any
8school year thereafter, make no adjustment add the amount determined under s.

21may increase its revenues for the 2017-18 school year or for any school year
22thereafter to an amount that exceeds the amount calculated as follows:

24and property taxes levied for the previous school year, excluding property taxes

1levied for the purpose of s. 120.13 (19) and excluding funds described under sub. (4)
2(c), by the average of the number of pupils enrolled in the 3 previous school years.
SB21-AA1,4,33 2. Add the following to the result under subd. 1.:
SB21-AA1,4,54 a. For the 2016-17 school year, $150 multiplied by the sum of 1.0 plus the
5allowable rate of increase under s. 73.0305 expressed as a decimal.
SB21-AA1,4,86 b. For the 2017-18 school year and each school year thereafter, the per pupil
7amount under this subdivision multiplied by the sum of 1.0 plus the allowable rate
8of increase under s. 73.0305 expressed as a decimal.
SB21-AA1,4,109 3. Multiply the result under subd. 2. by the average of the number of pupils
10enrolled in the current school year and the 2 preceding school years.
SB21-AA1,11 11Section 11. 121.91 (2m) (r) 1. (intro.) of the statutes is amended to read:
SB21-AA1,4,1512 121.91 (2m) (r) 1. (intro.) Notwithstanding pars. (c) to (i) (j), if a school district
13is created under s. 117.105, its revenue limit under this section for the school year
14beginning with the effective date of the reorganization shall be determined as follows
15except as provided under subs. (3) and (4):

18per pupil allowed under this subsection for the previous school year multiplied by the
19sum of 1.0 plus the allowable rate of increase under s. 73.0305 expressed as a decimal
20to the result under subd. 1. a., except that in calculating the limit for the 2013-14
21school year and the 2014-15 school year, add $75 to the result under subd. 1. a., and
22in calculating the limit for the 2015-16 and 2016-17 school year years, add $150 to
23the result under subd. 1. a., and in calculating the limit for the 2017-18 school year

24and any school year thereafter, make no adjustment to the result under subd. 1. a.
25add the amount determined under par. (j) 2. to the result under subd. 1. a.

1Section 13. 121.91 (2m) (s) 1. b. of the statutes is amended to read:

SB21-AA1,5,15 122. Page 195, line 7: decrease the dollar amount for fiscal year 2015-16 by
13$113,100,000 and decrease the dollar amount for fiscal year 2016-17 by
14$247,400,000 for the purpose of providing Medical Assistance to certain adults with
15incomes up to 133 percent of the federal poverty line.

SB21-AA1,5,19 17"(5f) Medicaid expansion. The treatment of sections 49.45 (23) (a) and 49.471
