TO ASSEMBLY BILL 554

AB554-SA7,1,11 At the locations indicated, amend the bill as follows:
AB554-SA7,1,4 21. Page 3, line 1: delete the material beginning with that line and ending with
3page 4, line 19, including the material inserted by assembly amendment 2, and
4substitute:
AB554-SA7,1,6 5" Section 1m. 66.0817 (4) of the statutes is renumbered 66.0817 (4) (a) and
6amended to read:
AB554-SA7,2,47 66.0817 (4) (a) After Except as provided in par. (b), after the price and other
8terms are fixed under sub. (3), the proposal shall be submitted to the electors of the
9municipality. The notice of the referendum shall include a description of the plant
10and a summary of the preliminary agreement and of the price and terms as fixed by
11the department of transportation or public service commission. If a majority voting
12on the question votes for the sale or lease, or if a referendum is not required under
13par. (b)
, the board or council may consummate the sale or lease, upon the terms and

1at a price not less than fixed by the department of transportation or public service
2commission, with the proposed purchaser or lessee or any other with whom better
3terms approved by the department of transportation or public service commission
4can be made.
AB554-SA7,2m 5Section 2m. 66.0817 (4) (b) of the statutes is created to read:
AB554-SA7,2,136 66.0817 (4) (b) If the proposal is for the sale or lease of a public utility that
7furnishes water or sewer service to an investor-owned public utility, a referendum
8under par. (a) is required only if, within 60 days after the adoption of a resolution or
9ordinance under sub. (1), a petition conforming to the requirements of s. 8.40
10requesting submission of the proposal to the municipality's electors, signed by a
11number of qualified electors equal to at least 10 percent of the votes cast in the
12municipality for governor at the last general election, is filed in the office of the
13municipal clerk.".
AB554-SA7,2,14 142. Page 5, line 9: delete lines 9 and 10 and substitute:
AB554-SA7,2,18 15"(1m) The renumbering and amendment of section 66.0817 (4) of the statutes
16and the creation of section 66.0817 (4) (b) of the statutes first apply to proposals
17under preliminary agreements that are executed on the effective date of this
18subsection.".
