SB885,1,2 1An Act to create 20.435 (7) (bm) and 146.619 of the statutes; relating to: grants
2for patient lift devices and making an appropriation.

This bill requires the Department of Health Services to establish and
administer a program to award grants to community-based residential facilities,
hospices, nursing homes, and residential care apartment complexes for the purchase
of patient lift devices. In order to receive a grant, an applicant must meet criteria
established by DHS, including a requirement to report data as specified by DHS or
a third party under contract with DHS. Grant recipients must spend grant moneys
only on patient lift devices that 1) are approved by DHS, 2) can be operated
independently by a patient or resident, 3) can be operated by or with the assistance
of facility staff, and 4) aid in mechanically lifting a human.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

SB885,2 1Section 2 . 20.435 (7) (bm) of the statutes is created to read:
SB885,2,42 20.435 (7) (bm) Patient lift devices grant program. As a continuing
3appropriation, the amounts in the schedule for patient lift device grants and data
4collection under s. 146.619.
SB885,3 5Section 3 . 146.619 of the statutes is created to read:
SB885,2,7 6146.619 Patient lift devices grant program. (1) Definitions. In this
7section:
SB885,2,98 (a) “Community-based residential facility” has the meaning given in s. 50.01
9(1g).
SB885,2,1010 (b) “Hospice” has the meaning given in s. 50.90 (1).
SB885,2,1111 (c) “Nursing home” has the meaning given in s. 50.01 (3).
SB885,2,1312 (d) “Residential care apartment complex” has the meaning given in s. 50.01
13(6d).
SB885,2,17 14(2) Grants. (a) The department shall establish and administer a program to
15award grants to community-based residential facilities, hospices, nursing homes,
16and residential care apartment complexes for the purchase of patient lift devices that
17comply with the requirements of par (d) 1. to 4.
SB885,3,418 (b) A community-based residential facility, hospice, nursing home, or
19residential care apartment complex that desires to participate in the grant program

1under this subsection shall file an application with the department. The department
2shall award grants to applicants on the basis of criteria determined by the
3department that includes an agreement that the applicant will participate in data
4reporting as specified under sub. (3) (a).
SB885,3,65 (c) A recipient of a grant under this subsection shall report data as specified
6under sub. (3) (a).
SB885,3,87 (d) Moneys awarded under this subsection shall be expended for the purchase
8of patient lift devices that meet all of the following requirements:
SB885,3,99 1. Are approved by the department.
SB885,3,1010 2. Can be operated independently by a patient or resident.
SB885,3,1111 3. Can be operated by or with the assistance of facility staff.
SB885,3,1212 4. Aid in mechanically lifting a human.
SB885,3,16 13(3) Data reporting and collection. (a) The department shall specify the type
14and form of data reporting required for recipients of grants under sub. (2). The
15department shall facilitate the collection and analysis of the reported data. The
16department may contract with a 3rd party to implement this paragraph.
SB885,3,1817 (b) No more than $100,000 from the appropriation under s. 20.435 (7) (bm) may
18be expended on data collection and analysis under par. (a).
