SB478,1,2 1An Act to amend 944.20 (1) (a) and (b) and 944.20 (2) of the statutes; relating
2to:
intentional exposure of genitals and providing a penalty.
Analysis by the Legislative Reference Bureau
Current law prohibits a person from publicly and indecently exposing genitals
or pubic area. A person who violates the prohibition is guilty of a Class A
misdemeanor. This bill eliminates the element that the exposure be indecent and
instead requires that the exposure be intentional.
Because this bill creates a new crime or revises a penalty for an existing crime,
the Joint Review Committee on Criminal Penalties may be requested to prepare a
report.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB478,1 3Section 1. 944.20 (1) (a) and (b) of the statutes are amended to read:
SB478,1,54 944.20 (1) (a) Commits an indecent act of sexual gratification with another
5with knowledge that they are in the presence of others; or.
SB478,1,76 (b) Publicly and indecently Intentionally exposes genitals or pubic area in a
7public area
.

1Section 2. 944.20 (2) of the statutes is amended to read:
SB478,2,32 944.20 (2) Subsection (1) does not apply to a mother's breast-feeding of her
3child. Subsection (1) (b) does not apply to diapering a baby.
