SB324,1,2 1An Act to amend 20.931 (title); and to create 20.931 (3) of the statutes; relating

restrictions on use of certain refrigerants.

Current federal law provides that, to the extent practicable, certain
ozone-depleting substances must be replaced by chemicals, product substitutes, or
alternative manufacturing processes that reduce risks to human health and the
environment. The U.S. Environmental Protection Agency is required to promulgate
administrative rules identifying acceptable alternatives to these ozone-depleting
substances.
This bill provides that no state agency and no local governmental unit may
prohibit or limit the use of a refrigerant that the EPA has designated as acceptable
for use.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB324,1 3Section 1. 20.931 (title) of the statutes is amended to read:

SB324,2 5Section 2. 20.931 (3) of the statutes is created to read:

120.931 (3) Prohibitions of certain refrigerants. No state agency and no local
2governmental unit may prohibit or otherwise limit the use of a refrigerant
3designated as acceptable for use pursuant to 42 USC 7671k, provided that any
4equipment containing the refrigerant is listed and installed in accordance with
5safety standards and use conditions imposed pursuant to the designation of the
6refrigerant as acceptable for use.
