AB866,1,2 1An Act to amend 125.06 (6) and 125.09 (6) of the statutes; relating to: the sale
2of alcohol beverages by a municipality or county in a park.

This bill allows a municipality or county to sell wine and distilled spirits in its
public parks without an alcohol beverage license.
Under current law, with limited exceptions, no person may sell alcohol
beverages to a consumer unless the seller possesses a license or permit authorizing
the sale. Under one exception, no license or permit is required for the sale, by officers
or employees of a county or municipality, of fermented malt beverages (beer) in a
public park operated by the county or municipality.
The bill applies this exception to wine and distilled spirits, along with beer.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB866,1 3Section 1. 125.06 (6) of the statutes is amended to read:
AB866,1,74 125.06 (6) Public parks. The sale of fermented malt alcohol beverages in any
5public park operated by a county or municipality. Fermented malt Alcohol beverages
6shall be sold by officers or employees of the county or municipality under an
7ordinance, resolution, rule, or regulation enacted by the governing body.

1Section 2. 125.09 (6) of the statutes is amended to read:
AB866,2,42 125.09 (6) Municipal stores sales. No municipality may engage in the sale of
3alcohol beverages, except as authorized under s. ss. 125.06 (6) and 125.26 (6). This
4subsection does not apply to municipal stores in operation on November 6, 1969.
